COLUMBUS, Ohio -- A Franklin County grand jury indicted a man on Monday in connection with the death of a 5-year-old girl.

Lindsay Bruce, who was already convicted in kidnapping Emily Rimel, was charged with her murder, NBC 4's Holly Hollingsworth reported.


Bruce, 25, was indicted on four counts, including two counts of aggravated murder. He was also cha
rged with murder and tampering with evidence, Hollingsworth reported.


Bruce could face the death penalty if he is convicted. He is already serving a 10 year sentence, the maximum sentence possible for the kidnapping charge, NBC 4 reported.

The indictment came a month after Rimel's remains were found in Big Walnut Creek in southern Franklin County. A woman who was fishing with her son found the child's skull.

DNA was taken from three of the five teeth in the skull. At the state's crime laboratory, the DNA was matched with the girl's DNA, along with the DNA from her mother and father, NBC 4 reported.

Police obtained Rimel's DNA from a winter coat, Burton reported.

Rimel was last seen inside her Madison Township home in December 2004. The 5-year-old girl disappeared from her home while Bruce, who was called a family friend, was visiting.



Detectives believed the girl died, but Bruce was not charged with her murder. Bruce was accused of raping her after
Rimel's DNA was allegedly found on his genitalia, NBC 4 reported. A jury later found Bruce not guilty on the rape charge.

Franklin County Prosecutor Ron O'Brien said he did not expect a plea agreement from Bruce, who could face the death penalty if convicted.

"He refused to do it then. He refused to do it thereafter," O'Brien said. "He refused to do it before the start of the rape and kidnapping trial. I would not expect there to be any attempt at pleas in this case."

Bruce, who is being housed at the Warren Correctional Institution in southwest Ohio, is scheduled to be arraigned on the murder charge later this week, Hollingsworth reported.

Mom cries through testimony at Rimel suspect trial

COLUMBUS (AP) - A woman sobbed while holding her daughter's tennis shoes and testifying against the man accused of killing the girl.

As she looked at photographs of her daughter Emily Rimel's things - a backpack the 5-year-old toted to kindergarten, a purple winter coat and Winnie the Pooh bedsheets - Jane Rimel struggled to tell jurors about her relationship with Lindsey Bruce, 25, a family friend accused of abducting and killing the girl in 2004.

"She knew Lindsey ever since she was 2 1 /2. She had no reason to be afraid of him," she said Wednesday.

Bruce was a family friend who occasionally slept on the couch at the home Jane Rimel shared with her boyfriend. He was staying at the apartment near Columbus the night of Dec. 6, 2004, but both Bruce and Emily Rimel were gone when Jane Rimel returned from work the next morning.

Last year investigators determined a skull found in a creek was Emily's. Part of the creek is about 300 yards from Emily's home and the skull was found about six miles downstream of that area, authorities said. The rest of her body was never recovered.

Bruce, already serving time in prison after being convicted in 2005 of kidnapping the girl, could face the death penalty if found guilty of aggravated murder.

During his previous trial, Bruce was acquitted of a rape charge.

Jane Rimel dabbed her eyes with a tissue as she testified in Franklin County Common Pleas Court about her frantic search for her daughter on Dec. 7, 2004. She said the girl complained of a cold the night she disappeared and would not have gone out without her shoes, which were found inside the apartment.

"I need my daughter back," she cried.

Prosecutors say police found a close match to Emily's DNA on Bruce's body and that he confessed to killing the girl to other inmates.

Bruce's attorney questioned the reliability of jailhouse informants, calling the state's case circumstantial and weak.

"We must go through this process to receive a fair trial, free of sympathy, empathy, prejudice and bias," defense attorney Christopher Cooper said. "It's a difficult case, and everyone wants closure, but so does the family of Lindsey Bruce."

Kidnapper said he killed girl, inmate testifies

An inmate who served time with Lindsey Bruce became the first in a possible string of prisoners expected to say Bruce confessed to killing 5-year-old Emily Rimel more than two years ago.

There are a dozen current or former inmates on the prosecution’s witness list in Bruce’s aggravated-murder trial in Franklin County Common Pleas Court.

Yesterday’s witness offered shocking new information for jurors:

"He came to me because he was nervous and didn’t know who to turn to," the inmate said. "He said he raped her and he killed her. He said he cut her head off."

Though authorities never determined how Emily died or whether she had been decapitated, only her skull was found when her remains were discovered 17 months after her disappearance on Dec. 7, 2004.

The bulk of yesterday’s testimony came from Brent Copley, who was the boyfriend of Emily’s mother, Jane, when the child disappeared. He is now married to Jane Rimel. He said that Bruce, a mechanic, had been his friend for 10 years.

On the night Emily disappeared from her Madison Township apartment, Bruce dropped by twice to visit Copley while Jane Rimel was at work overnight.

During the second visit, he plopped onto the couch and appeared to go to sleep, something he often did after a night of drinking, Copley said.

Copley said he then fell asleep in bed himself, and that he typically is a deep sleeper. He said Emily and her brother were asleep in their beds.

Because police have video of Bruce playing pool about 3 a.m. at a nearby all-night pool hall, it’s believed he went to Copley’s home shortly after that. He cannot account for his whereabouts from 3 a.m. to 9 a.m. that day, police said.

The next morning, Bruce and Emily were gone and the front door was unlocked.

But Copley said he didn’t consider Bruce a suspect until days later, when police said they’d found the girl’s DNA on Bruce’s genitals and he was arrested. Both Copley and Jane Rimel consented to searches and DNA swabs after the girl’s disappearance, but Bruce refused. Detectives obtained a court order within 13 hours of the girl’s disappearance to test him.

Under questioning by Cooper, Copley said Emily sometimes walked to school or a nearby playground with her mother or him. He said her grandmother lived in the same complex and that two sexual predators lived within a mile of their Reinbeau Drive apartment.

But Copley also added: "She never left the house by herself. She wasn’t raised that way."

Jury finds Lindsey Bruce guilty in girl's murder

A jury this afternoon found Lindsey Bruce guilty of killing 5-year-old Emily Rimel.

Emily would have turned 8 on Saturday.

The Franklin County jury, seven women and five men, announced its verdict at 4:15 p.m.

Bruce was charged with aggravated murder, murder and tampering with evidence in the killing of Emily, who disappeared overnight from her apartment on Reinbeau Drive in Madison Township. Her skull was found 17 months later on a bank of Big Walnut Creek, 8 miles south of her home.

The jury, which was handed the case on Wednesday, found Bruce guilty of one count of aggravated murder, one count of murder, and one count of tampering with evidence. It also found him not guilty of one count of aggravated murder.

Bruce, 25, is a self-employed mechanic who became friends with Brent Copley more than 10 years ago. Copley later moved in with Jane Rimel and her daughter, Emily. The couple had a son together.

Twenty-one witnesses testified during the death-penalty trial.

According to testimony: On Dec. 7, 2004, Bruce visited the apartment twice late at night. He had been drinking at a Refugee Road bar and sometimes used the apartment as a place to flop. His former girlfriend, Lila Wright, lived there for three months that year and he frequently visited her overnight.

That night, Bruce was the last adult to leave the apartment, and he apparently left the door unlocked instead of waking Copley, which prosecutors said was his custom. Emily was nowhere to be found when Copley woke up at 8 a.m.

Prosecutors said Bruce kidnapped the girl and killed her to conceal a rape, then discarded her body in nearby Heisel Park. Emily's DNA was found on his genitals, and his right forearm had three small scratches. He was arrested 10 days later.

Bruce told police and the FBI he left the apartment about 3 a.m. and worked on cars. He could not prove where he was until 9:27 a.m., when he received a store receipt for buying a car part.

Defense attorneys said the DNA evidence is suspect and no other evidence proves Bruce did anything to the girl.

Testimony by defense witnesses indicated that Rimel and Copley were poor guardians of Emily and that the girl had left the apartment on her own before.

Bruce is serving a 10-year prison term after having been convicted of kidnapping Emily at a previous trial. Men incarcerated with him have testified in both trials that Bruce confessed to the murder.

COLUMBUS, Ohio - A judge imposed the recommendation of a jury on Thursday that Lindsey Bruce, the man found guilty on the slaying of a 5-year-old girl, spend life in prison without the possibility of parole.

The jury had deliberated Bruce's fate less than two hours before returning a sentence and that worried his lawyers.

"You think that a verdict that fast is not going to be good for us in a case like this," said defense attorney Don Schumacher.

"We therefore unanimously find that the sentence of life in prison without the possibility of parole should be imposed on Lindsey Bruce," read Franklin County Common Pleas Court Judge Patrick Sheeran.

Emily Rimel's mother, Jane Rimel, was clearly upset that the man who killed her daughter would live.

"This is so stupid, there's no justice in this world," Jane Rimel said.

"It's a sad case, a tragic case on everybody's part," said Bruce's attorney Christopher Cooper. "But taking another life doesn't bring Emily back. We're happy that the jury spared his life."

In 1992, the fates that conspired to place Columbus Police Chief James Jackson cheek by jowl with a 10-year-old creator of just-say-no, D.A.R.E. doggerel appeared to have the purest of motives.

Slap a smiling photo of Jackson on the front of a Columbus Clippers baseball card and, on the back, allow a Columbus elementary-school student to speak (in rhyme, no less) for the chief on the issue of drug and alcohol abuse.

It isn't Robert Frost, but the youngster makes his point in a quirky, Burma Shave kind of way:

Be a winner and not a loser,

Don't take drugs or be a boozer.

The youngster was Beatty Park Elementary student Lindsey Bruce.

Yes, that Lindsey Bruce -- recently convicted murderer in the Emily Rimel case.

Goodbye, Columbus?

James G. Jackson, who in 1990 became the first black police chief of Columbus, Ohio, spent much of 1996 on the ropes, and ends the year suspended with pay for allegedly using his position to hire family members and friends and mishandling matters related to the investigation of a prostitution ring.

Jackson’s suspension was announced Nov. 29 by Mayor Greg Lashutka, after Safety Director Thomas Rice brought five administrative charges against the chief. Rice said an investigation by the Mayor’s office had concluded that Jackson “disregarded facts, testimony and evidence"� when he overruled a deputy and cleared Cmdr. Walter Burns of seven departmental charges for allegedly mishandling the prostitution investigation in 1992 and 1993.

In addition, Rice asserted, Jackson ordered the destruction of records in the prostitution probe.

The Columbus Dispatch reported Nov. 3 that the mayoral investigation also focused on whether officers illegally accessed police computers and passed along confidential information to operators of a gambling operation and a prostitution ring. Among the information believed to have been leaked to outsiders is the identities of undercover officers and the findings of background checks conducted on customers and employees of the illegal operations.

The Police Division’s internal affairs bureau confirmed last year that the agency’s link to the statewide Law Enforcement Automated Data System had been accessed illegally. Jackson was one of at least six supervisors who were informed of the breach, but did not report it to the state Highway Patrol, which oversees LEADS.

Sources told The Dispatch that Jackson is not suspected of improperly using the computers, but a Highway Patrol sergeant said that the failure to notify the patrol of computer security problems, while not a crime, violated a signed administrative agreement between the two agencies.

The investigation of Jackson, which began Oct. 10, was an expansion of an internal inquiry ordered last June by Rice. Jackson has filed suit against Rice and the city, in which he contends he was illegally suspended and is entitled to a hearing before the Civil Service Commission.

Jackson was reassigned to his house when the investigation was first announced. He later was allowed to report to duty at Fire Service headquarters but refused and began calling in sick and taking vacation days.
