Mahomed Azeem Yunus, 37, a father of three, was convicted of murder and attempted murder in the High Court in Pietermaritzburg on Friday.

Yunus was charged with murder in 2007 after firing shots at a vehicle on the N3, killing the driver, Vinod Ramsarup, and injuring Sara Sathar and her daughter, Abidha.

Ramsarup was giving Sathar and her daughter a lift to Pietermaritzburg, where she was going to visit her son, Mohamed Shuaib Sathar, in prison.

In his judgment, Judge Achmat Jappie said tensions had grown between the Sathar and Yunus families after Sathar's son had allegedly killed his cousin, Safia Mahomed, in September 2005. Safia was Yunus's sister. That case has not been finalised.

The judge said a witness, Paul Henderson, had described the shooting and noted the registration of the vehicle.

He said a surgeon's report revealed that Sathar had been shot 12 times and Ramsarup had died after suffering injuries to his neck, chest and arms.

He rejected Yunus's testimony that he had seen, in his rear-view mirror, Sathar with a gun.

He said Yunus told the court he was afraid of Sathar because he believed she was violent and was conspiring to have him killed. However, he said, he found her to be a truthful witness.

He said Sathar confirmed she had a licensed gun but did not carry it with her on the day of the shooting. "Although she owned a firearm, it was left at home and was found at her home."

Neither Sathar nor Yunus reacted to the guilty verdict. Ramsarup's wife was not in court.

State prosecutor Sandesh Sankar opposed bail, saying that it "would send a wrong message to the community". He said Yunus should be detained until sentence was imposed.

However, the judge granted bail on condition that Yunus report to a police station daily, that he not leave Escourt and that he not have contact with witnesses.

Sentencing will be on May 21.
