Shaken Baby Trial

It looks like the man accused of killing a fourteen month old Texarkana child will probably not go to trial next month.
Tyrone Edmond, 21, was scheduled to go to trial January 24th, but one of his lawyers withdrew from the case.

He is charged with the capitol murder of Jaden Johnson from October 2003.
Officials say the child suffered injuries from being shaken.

The prosecutor is seeking the death penalty in the case and says a new trial date will be set once Edmond has a new legal team in place.

Smithfield Man Charged With Shaking Baby

SMITHFIELD, N.C. -- A 4-month-old Smithfield girl who was shaken violently has lost her eyesight and ability to function normally, authorities say.

On Tuesday morning, Smithfield police charged the baby's father, Cedrick Donelle Simms, 19, of Apex with felony child abuse.

``It's a miracle the baby survived,'' said Smithfield Police Capt. Bruce Gentry. ``Technically she's alive, but she has no mental capacity.''

The baby, Kyniyah Anai Mayo, has a ``permanent loss of all mental function,'' according to the arrest warrant.

She has been in an intensive care unit of UNC Hospitals in Chapel Hill for two weeks. The two frontal lobes of her brain, which

control motion and short-term memory, are not functioning, and her sight loss is appare
ntly permanent, Assistant District Attorney Elisabeth Dresel said.

``The ability for this child to grow up and be normal is gone,'' Gentry said.

Emergency medical technicians took the baby to Johnston Memorial Hospital on Jan. 18 after Simms called 911 for help.

Simms, who began living with Kyniyah and her mother, Gwendolyn Mayo, just days before, had been home watching the child, Gentry said.

Mayo had left her home earlier that morning to attend a class at Johnston Community College, he said.

Doctors at Johnston Memorial found bleeding in Kyniyah's brain and had her taken by helicopter to Chapel Hill, Gentry said.

There, doctors diagnosed the child with shaken baby syndrome, a condition involving injuries from vigorous shaking of an infant by the arms, legs, chest or shoulders.

The Johnston County Department of Social Services has terminated Simm

#39; and Mayo's parental rights and assumed temporary custody of Kyniyah, Gentry said.

Simms was being held Tuesday
in the Johnston County Jail under $50,000 bail.

Hopkins Father Arrested For Child Abuse

(Hopkins) A father is in custody after allegedly shaking his 2-year-old son and leaving him in critical condition.

Twenty-four-year-old Robert Hutto, Jr. is charged with Inflicting Permanent Injury to a Child. The child, who lives with his mother in Columbia, was visiting his father in Hopkins. Authorities say Hutto pushed the toddler, causing him to fall, then picked him up and shook him violently.

The child is listed in critical condition. If he dies, the charge will be upgraded to Death by Child Abuse.

Hutto's bond was set at $75,000.

Father charged with killing son faced child abuse charges before

(Richland) Aug. 16, 2005 - News 10 has learned that Robert Hutto, who is now charged in the death of his son, has been charged before with child abuse.

Deputies say Robert Hutto shook his son so violently, it eventually killed the child. The little boy's name was Shamaree Brown. He was only two.

Shamaree Brown's mother brought him to Palmetto Health Richland where the little boy remained in critical condition for over a week, until Sunday, when he finally gave up his fight.

Coroner Gary Watts has no doubt, "The baby definitely died as a result of the injuries sustained when he was shaken by hi
s father."


Watts says, "Talking with the pathologist this morning, it's pretty obvious that this child would have had some serious injuries if he had in fact survived."

But he didn't survive.

WIS has learned that this isn't the first time Hutto has been accused of harming a child, according to police reports.

Hutto has another son. Just last year, Hutto was charged with cruelty to children when, according to police reports, he hit his five year old son with a belt, bruising the child's thigh, forearm and back.

Family members tell News 10 Hutto went before a magistrate in that case, but never served any time. He was charged a $550 fine.

Hutto is currently behind bars awaiting a bond hearing on charges of homicide by child abuse.

of Hutto's other son, say that young man, now six, saw his dad on the news Sunday night. He told his family that he wants to be in the court room for that bond hearing.
