3 face murder charges - No bail set for men charged in bank robbery, trooper's slaying.
Three men now face murder charges in the shooting death last week of a state trooper in Big Flats.
Anthony Horton, 33, of Elmira, and brothers Bryan Adams, 45, and Wayne Adams, 42, both of Horseheads, were arraigned Thursday afternoon in Chemung County Court following their indictment Tuesday by a county grand jury.
Police believe Horton shot and killed trooper Andrew Sperr, 33, following a bank robbery and that Bryan Adams was in the pickup truck with Horton when Sperr was killed. Police also believe Wayne Adams was the lookout at the robbery.
Horton was charged in a 10-count indictment,
including three counts of first-degree murder, one count of second-degree murder, three felony robbery counts and three counts of criminal possession of a weapon.
The first-degree murder charges include aggravated murder, which is used in cases involving law enforcement officers, and c
arries a mandatory life sentence.
"He will still face life without parole (if convicted)," Chemung County District Attorney John Trice said. "On the other ones, he could get 25 years to life or life without parole."
Wayne and Bryan Adams were charged with second-degree murder, first-degree robbery and second-degree robbery. Wayne Adams was initially only charged with robbery.
"They were charged with these because they acted in concert (with Horton) and aided his flight," Trice said. "Wayne was charged early (March 2). At that time, we didn't have all the facts. New evidence was presented to the grand jury. The grand jury voted on all the evidence
presented to them."
Horton and Bryan Adams were both shot by Sperr before he died, police said.
Horton, who was shot four times in the lower body, was brought into court Thursday in a wheelchair. The suspects were brought in one at a time for arraignment before Chemung County Judge James Hayden.
