A Bronx day care worker was busted on child pornography charges after one of the kids from the center he worked at appeared in lewd footage, authorities said this week.
Silfredo A. Castillo Martinez, 32 – who works at Lina’s Garden Day Care – operating out of his home on Decatur Avenue near East Gun Hill Road in Williamsbridge – was busted May 3, cops said Monday.
According to the police, he is accused of “possessing multiple pornographic images of sex acts with children.”
Police said one of the day care’s charges was a victim – and released Martinez’s mugshot as they investigate whether he had any other young victims.
He was charged with promoting a sexual performance by a child, and possessing a sexual performance by a child, authorities said.
Martinez was employed by the center from July 2011 until his arrest this month, cops said.
The day care search website Winnie indicates the license for Lina’s Garden Day Care “is currently inactive, in renewal, or no longer in use.”
State records show the day care had the capacity for 12 children, ages 6 weeks to 12 years, plus four additional school-aged kids.

A Bronx day care owner has been indicted on multiple charges for allegedly sexually assaulting a boy under his care, prosecutors said Monday.
Silfredo Castillo Martinez, 32, owner of Lina’s Garden Day Care, which operated out of his home, has also been accused of possessing a collection of child pornography and he was first charged for that offense last month, authorities said.
The NYPD and US Secret Service raided Martinez’s home day care, located on Decatur Street in Williamsbridge, and seized 30 devices on May 3, according to the Bronx District Attorney’s Office.
The investigation found he allegedly downloaded 12 child pornography files in his Google Drive account, including images and videos of boys between the ages of seven and 12. One child was even as young as one, the district attorney’s office said.
As the investigation moved forward, authorities found a photo and video of a child that was taken inside the day care, which prosecutors allege is the boy who was sexually abused by Martinez.

“The defendant, a daycare owner, was supposed to keep children safe, instead he allegedly sexually assaulted a boy in his care,” Bronx District Attorney Darcel Clark said in a statement.

“[Martinez’s] actions are despicable and sickening, and he cannot be caring for children in our community.”

Martinez was arraigned Monday on a slew of charges, including two counts of predatory sexual assault against a child, two counts of first-degree criminal sexual act and and 12 counts of possessing a sexual performance by a child.

Bail was set at $500,000, cash or bond, by Bronx Supreme Court Judge George Villegas and Martinez is due back in court Sept. 20.

A call to the attorney representing Martinez, H. Benjamin Perez, listed by the district attorney’s office, was not returned Monday evening.

The day care search website Winnie stated Lina’s Garden Day Care was closed.

Ohio attorney general on lack of investigation into alleged child rapist

An Ohio man was charged Wednesday with raping and impregnating a 10-year-old girl, whose story of traveling across state lines to get an abortion was told by President Biden following the repeal of Roe v. Wade.
Gershon Fuentes, 27, of Columbus, was arrested Tuesday and confessed to sexually assaulting the child at least twice, according to the Columbus Dispatch.
A detective testified in court that local child services alerted the police about the child’s circumstance after her mother had reached out on June 22, the paper said. The same investigator confirmed that the child was then brought to Indiana, where she was given an abortion.
Authorities are cross-referencing DNA from the clinic in Indianapolis with samples from Fuentes.
Judge Cynthia Ebner set a $2 million bail for Fuentes, who is being held in Franklin County jail and might be undocumented, according to the Dispatch. He is facing a felony charge of rape.

President Biden faced skepticism after he repeated the horrifying story while pushing for his executive order on abortion.

“Imagine being that little girl,” Biden said. “I’m serious, just imagine being that little girl. Ten years old!”

The charges brought Wednesday appear to vindicate the president.

Ohio Attorney General Dave Yost questioned the tale on Fox News, writing that he was unaware of the story, and despite being in regular contact with authorities, he had heard “not a whisper.”

The original story was relayed by Indianapolis OB-GYM Dr. Caitlin Bernard, who said the child was six weeks and three days pregnant, making it too late for her to receive abortion care under Ohio’s restrictive abortion law triggered by the Supreme Court’s Dobbs decision.

More On: rape

The mother of a 10-year-old Ohio girl who crossed state lines to get an abortion has defended her daughter’s 27-year-old confessed rapist — who was wrongly listed as a minor during the medical visit, according to reports.
The mom spoke to Telemundo while hiding behind the door of the Columbus apartment that was also listed as the home of rapist Gerson Fuentes, an illegal immigrant from Guatemala.
“She’s my daughter,” the mom, who refused to give a name, confirmed to Telemundo of the girl who would have been just 9 when she was abused and impregnated.
“She’s fine. Everything that they’re saying against him is a lie,” she insisted of Fuentes, who confessed during police interviews to raping the youngster at least twice, according to court records and officials.
The defensive mom, who hid her face when speaking to Telemundo in Spanish, insisted that she had not been the one to file charges against her young daughter’s abuser.

The shocking case came to light when the girl was taken across state lines to terminate the pregnancy in Indiana on June 30, with President Biden highlighting it as proof of the evils of anti-abortion legislation.

However, despite Fuentes being 27, the person listed as getting the girl pregnant was described as a minor in the report her abortionist sent to authorities, according to Fox News Digital, which obtained a copy.

Dr. Caitlin Bernard listed the rapist as being approximately 17 in her official filing to the Indiana Department of Health, the outlet said.

It was not immediately clear if Fuentes was identified in the document. Fox only said it showed how Bernard reported performing a non-surgical abortion for a 6-weeks-pregnant 10-year-old girl of Mexican ethnicity on June 30.

Bernard was the one who then highlighted the tragic case in an interview with the Indy Star on July 1.

The doctor’s attorney, Kathleen DeLaney, insisted that Bernard “took every appropriate and proper action in accordance with the law and both her medical and ethical training as a physician.”

“She followed all relevant policies, procedures and regulations in this case, just as she does every day to provide the best possible care for her patients,” she told Fox.

DeLaney also said they are “considering legal action against those who have smeared my client, including Indiana Attorney General Todd Rokita,” who is investigating Bernard’s actions.

Fuentes was busted Tuesday, and is being held on $2 million bond after being charged with felony rape of a minor under 13 years old in the case. He is scheduled back in court next Friday.

“My heart aches for the pain suffered by this young child,” Ohio Attorney General Dave Yost said.

“I am grateful for the diligent work of the Columbus Police Department in securing a confession and getting a rapist off the street,” he said.

A creep set loose without bail after the Manhattan District Attorney’s Office downgraded his robbery charges was arrested again months later for trying to rape a 15-year-old girl in a horrifying attack in The Bronx, sources said Thursday.
Anthony Ibanez, 32, allegedly shoved the girl to the ground at around 2:40 a.m. Wednesday in Parkchester, sexually assaulted her and then chillingly threatened, “I’m going to take you to a quiet place and f—k you,” according to the criminal complaint against him.
Sources said a good Samaritan stepped in and stopped the attack, and Ibanez — who was roughed up by the unidentified hero — allegedly later went to the 43rd Precinct claiming to be the victim of an assault.
But cops recognized him from a description given by the teen and arrested him on charges of attempted rape, according to the sources.

At the time of the horrifying attack, Ibanez was out on no bail in a case from three months prior where he allegedly robbed a Hell’s Kitchen deli with a Taser-wielding accomplice.

He was busted May 25 after he and the partner-in-crime allegedly stole a tip jar and other items from the Plaza Gourmet Deli on Ninth Avenue near West 43rd Street, according to the criminal complaint in that case.

Jason Clark, 22, allegedly fired the stun gun when someone tried to stop Ibanez from running out of the store with the items, the court document states.

Cops charged Ibanez with robbery in the first degree with use of a dangerous instrument, an offense that would have been bail eligible under New York state’s criminal justice reforms.

But prosecutors with DA Alvin Bragg’s office downgraded those charges to non-bail eligible raps of petit larceny, second degree menacing, criminal possession of a weapon and criminal possession of stolen property.

The alleged thief was released on his own recognizance by a Manhattan judge one day after his arrest with a temporary order of protection issued against him, sources said. He had one prior marijuana arrest from a decade ago, but no other previous record in the state, according to sources.

“We make charging decisions based on the facts and circumstances of each case in accordance with the law,” Doug Cohen, a DA’s Office spokesman, said in a statement. “As detailed in court records, Mr. Ibanez was not in possession of a weapon and was found to have allegedly stolen approximately $7.”

Ibanez was arrested again on July 15 after he allegedly made off with about $50 worth of items from a 7-Eleven in Lower Manhattan, according to sources.

He allegedly had a hammer and a knife in his possession when he was busted — and police at the 1st Precinct let him go with a desk appearance ticket on petit larceny charges, the sources said.

But he never showed up to his scheduled court date, and while a warrant was issued for his arrest on Aug. 4, according to sources, he remained free to allegedly assault the teen girl early Wednesday.

Ibanez is accused of stalking the girl outside her Westchester Avenue apartment building as she used her phone to try to track down her AirPods, sources said.

After pushing her to the ground, the creep allegedly sexually abused the teen and then covered her mouth with his hand as he made his disturbing threat, court records said.

His bail was set at $150,000 by a Bronx judge at his arraignment on charges of attempted rape and sexual abuse Thursday morning.

There was no answer at a number listed for Ibanez’s attorney with the Legal Aid Society.

He’s due back in Bronx court Monday, while his next appearance in the Manhattan case is set for Friday.

A Yonkers man was sentenced to 50 years behind bars for “horrific” sex crimes against a child who said in a court statement the man ruined their childhood.
Convicted rapist Virgilio Cruz, 48, was hit with the maximum sentence – two consecutive 25-year prison terms – Tuesday after he was found guilty of multiple violent felony charges last month, according to the Westchester County District Attorney’s Office.
He was arrested in 2021 by Yonkers police, but not before he attempted to harm himself when he was confronted by the victim’s parents about his disgusting actions, the district attorney’s office said Tuesday.
Cruz was found guilty by a jury of first-degree rape, second-degree rape and first-degree course of sexual conduct against a child following a weeklong trial on Sept. 16.
The victim told Cruz in a statement read into the court record prior to the defendant’s sentencing “You ruined my childhood.”
“I felt horrible for so long… I didn’t want to be around people,” the victim’s statement said, according to the district attorney’s office.
“I was numb…. I never knew what you would do next or what more you were capable of… The two emotions I felt constantly were fear and sadness. You had no right to do what you did to me.
“After today, I won’t ever think of you again… After today, you are nothing to me.”
The victim was only 11-years-old when Cruz began to subject the child to sexual intercourse repeatedly in 2019, including some instances where the child was even asleep, prosecutors said. When the victim was 14-years-old, the defendant got into a struggle with the young teen before pinning down and raping the minor, prosecutors said.

The victim told a parent of Cruz’s despicable actions. When that parent confronted Cruz, he attempted to stab himself with a kitchen knife, the district attorney’s office said.
Police were called and the man was arrested in September 2021.
The victim’s gender was not released nor was the victim’s relationship to the defendant.
Cruz will also be registered as a sex offender and face 20 years of post-release supervision when his prison term ends.
“Today, this defendant was held to account for horrific crimes committed against a vulnerable child,” Westchester District Attorney Mimi Rocah said in a statement Tuesday.
“We hope the victim, who was extraordinarily brave and testified in court, can begin their journey to healing and feeling safe.
“My Office and I remain committed to bringing sexual predators to justice and protecting victims from sexual violence.”

‘Pervy’ NYC teacher Gabriel Mitey is back in a classroom — under a new name

Gabriel Mitey, 28, who is certified in special education, now goes by the name Gabriel Torres and teaches at a new NYC school.

A teacher booted from one city high school for flirting with students and posting a nearly nude photo of himself on Snapchat is back in the classroom at an elite Manhattan school under a different last name – with the apparent blessing of the city Department of Education, The Post has learned.
Gabriel Mitey, 28, who is certified in special education, worked last year at the Lower Manhattan Arts Academy, or LOMA, where several students complained to other faculty of bizarre behavior.
Mitey now goes by Gabriel Torres. And despite being the subject of five different probes, he is teaching classes in algebra and earth science at the highly coveted 6-12 Professional Performing Arts School, known as PPAS, in Midtown. A photo of a smiling Mitey on the cafeteria bulletin board identifies him as “Mr. Torres.”
A PPAS mom who had another child at LOMA last year first recognized the teacher as Mitey, insiders say. Word soon spread among students, who shared a Post article about allegations against Mitey, and told their parents.

To those who asked, a guidance counselor and Principal Kevin Ryan conceded that “Torres” is Mitey, parents said.
Ryan told parents he needed a special-ed teacher this fall, and the DOE sent “Torres,” who he said, “came highly recommended.”
Ryan insisted to parents the DOE did not inform him that Torres was actually Mitey, or divulge the teacher’s troubled history, until he asked higher-ups. “He feels the DOE played him,” said a father who learned of the subterfuge.
“I believe in second chances, but not when it comes to kids. I don’t want to risk my daughter in that type of situation,” said the dad, asking to remain anonymous to protect his child.
Gabriel MiteyGabriel Mitey posted a nearly nude photo of himself on Snapchat.
Parents and students were told that Mitey has not been charged with misconduct. The Special Commissioner of Investigation for city schools cited five investigations of Mitey in 2020 and 2021. SCI referred two cases to the DOE, and three others were closed, a spokesman said.
The SCI released no findings. The DOE refused all comment on Mitey, not saying if the two probes it handled are ongoing or closed, or whether the students’ complaints were substantiated.
Gabriel MiteyThe special-ed teacher now goes by Gabriel Torres.
Mitey’s father is a veteran city teacher and his mother is a city Health Department employee.
Rather than remove Mitey from LOMA last year pending investigation – which is standard practice for alleged sexual misconduct – he was kept on by Principal Derek Premo, who himself remains the subject of a sexual harassment complaint. Premo resigned in March.
Finally, after inquiries by The Post, the DOE pulled Mitey from the school in August 2021, citing “extremely disturbing allegations.”

In one case, a student told investigators that Mitey harassed him during remote instruction, and asked the teen to visit his apartment “for coffee” after graduation.

“He basically asked me on a date,” said the student. “I felt so uncomfortable going to his Zoom classes.”

In another case, student Jolissa Jones said Mitey obtained her mother’s permission to videotape the girl for a master’s degree course, then had Jolissa pretend to have difficulty reading on the tape. After she graduated, Mitey flirted with Jolissa in texts, she said, reminding her to delete their conversations: “Chat has got to disappear,” he wrote.

Mitey also posted a photo of himself in a bathroom with a towel barely covering his groin on Snapchat, where it was shared by many students who followed him on the social-media platform, Jolissa said.

Gabriel MiteyGabriel Mitey, under the last name Torres, now teaches at the elite 6-12 Professional Performing Arts School.
DOE returned Mitey to LOMA several months after yanking him, but students protested, holding up papers saying “Mitey Must Go!” One teen ran up on the stage during a music assembly and started yelling “We don’t want any pervert teachers,” a LOMA dad said.

Some parents at PPAS fear Mitey is not fit to work with kids.

“My biggest concern is that he’s allowed to be a teacher,” one said. “I’m mad about the school turning its back and looking the other way.”

Officials could not say if Mitey has legally changed his name. He did not return emails seeking comment. Nor did Ryan.

The city Department of Education has yanked a special-ed teacher from a Manhattan school after parents and students learned he had a history of inappropriate texting, flirting with teens, and posting a near-naked selfie — under a different name.
Gabriel Mitey, 28, came “highly recommended” to the 6-12 Professional Performing Arts School in Midtown while assuming the name “Gabriel Torres.”
The DOE ousted Mitey on Monday after The Post published a front-page story on the subterfuge.
“As of today, Oct. 31, Mr. Torres is no longer on the PPAS staff, and he will not return to PPAS, nor to any DOE school,” Principal Kevin Ryan said in a note to families, citing “a sizable amount of concern” about the teacher.
The news brought relief to parents.
“I feel more comfortable now that my daughter is in a school without that potential problem,” a dad said.
The DOE sent Mitey to PPAS last April when Ryan said he needed a special-ed teacher. He later told parents the DOE had deceived him, and that his hands were tied.
“I don’t think anything would have gotten done if it wasn’t for the press. We had to reach out to The New York Post,” the dad said.

A LOMA staffer said Mitey should have been removed after students first confided their discomfort with the teacher. Students spoke to investigators, showing Mitey’s text messages and the bathroom selfie in which a towel barely covered his groin.

“After kids came forward with that photo he’d sent through Snapchat, I was shocked that he was ever let back into the classroom, let alone given a glowing recommendation and a new position,” the staffer said. “The DOE needs to do better.”

A convicted murderer released on parole less than three months ago tried to kidnap an 8-year-old girl as her stepfather desperately pulled her away in a tug-of-war on a Bronx street this week, cops and the dad said.
Juan Rivera, 52 — who was only released from state prison in late August — “didn’t say a word” as he tried to pry the girl from her stepfather’s grip at Fox Street and St. John Avenue in the Woodstock neighborhood around 3:15 p.m. Wednesday, authorities said.
“He never said anything. He didn’t talk,” disturbed father Abraham Perez told The Post on Thursday. “Never said one single thing.”
Perez, a restaurant worker, had been walking the girl to buy snacks at the store after school at Girls Preparatory Charter School when he noticed a man staring and making a beeline toward them. When he tried to move out of the way, the man mirrored his movements, he said.
“He looked at my eyes. He looked very scary, very dangerous,” Perez, 38, said. “I tried to move but he kept walking straight towards me. He didn’t want to let us pass.”

Perez asked the man what the problem was but he didn’t answer and instead silently shoved the confused dad then pulled at the girl from her sweater collar.
“My daughter started screaming, saying ‘leave me alone, you don’t hurt my family, you don’t hurt my dad, please leave me alone,’” Perez said. “She was crying so loud, yelling, she was so scared.”
At one point, the man wrested the girl from Perez’s grip but she fought loose and grabbed her father’s arm again. Suddenly, the attacker let go and walked “slowly” toward Southern Boulevard as Perez flagged down a nearby NYPD cop car and the Rivera was arrested.
He was charged with kidnapping, unlawful imprisonment and harassment, authorities said.
“I f–ked up,” Rivera admitted, according to cops.
The attack has left the young girl terrified, Perez said.

“I don’t know if my daughter will ever be the same for the rest of her life,” he said. “Now my stepdaughter doesn’t even want to go outside, she’s afraid.”
“Her mother took her to school today and Maria didn’t want to let go of her mother’s hand. She was panicked,” he added. “She knows her school is very safe but she was not too confident. [She] was crying last night. She didn’t want to sleep alone.”
Rivera was last arrested on March 25, 2003, for fatally shooting a 33-year-old man in the Bronx, cops and police sources said.
He was convicted of second-degree murder and sentenced to 25 years to life, state correction records show.
He was held in the Franklin Correctional Facility in Malone, New York, from July 22, 2005, through Aug. 25 of this year, when he was released on parole, records show.
Police say he was also arrested for attempted murder on Oct. 25, 1993.
But that charge does not appear in correction records, which show he was held in the Altona Correctional Facility from May 1995 through September 2001 on burglary and weapon possession raps.

Wednesday’s bust marks Rivera’s sixth unsealed arrest in the Big Apple, cops said.

His record also includes raps for weapon possession and narcotics use, police said. His first bust was in 1988.

“People like this, it’s no good for them to be on the streets. He’s not a good guy,” Perez said. “Someone like that should not be let out of prison. He hurt my daughter so bad. I don’t want this to happen to another family.”

The incident left people in the “usually quiet” neighborhood shaken.

“If the guy who tried to snatch the little girl had done his time in prison, but he wasn’t right in the head, he should have been released into a mental health facility instead of being allowed to walk the streets,” building super Eric Quinsonez said.

“The justice system is letting us down.”

Paula Sanchez, 85, who raised five children on the same block of the kidnapping called the situation “very frightening.”

“I’ve lived here for 64 years and I’ve never heard of anything like this happening,” Sanchez said. “My little grandchildren go to PS 62 [on Fox Street]. I have to worry something like this could have happened to them.”

But I mean it doesn't stop me from coming in when I need to.
New Yorkers reflect on crime and safety in the city

A convicted murderer who tried to kidnap an 8-year-old girl in front of her dad on a Bronx sidewalk was ordered held without bail Friday – as the victim remained “upset, traumatized, and fearful,” prosecutors said.
Parolee Juan Rivera, 52, is facing up to life in prison after he tried to snatch a terrified youngster Wednesday afternoon in the Woodstock neighborhood – just blocks from where he fatally shot a man in 2003, prosecutors said in Bronx Criminal Court.
Rivera was on lifetime parole after being released from state prison in August, and had been on parole for burglary when he was charged in the second-degree murder case two decades ago, officials said.
“He had been placed on probation,” Judge Tara Collins said. “And he violated that probation. So it just shows he’s not able to follow the terms and conditions of his probation or just not leading a law-abiding life once he’s released on parole.”

The judge sided with the Bronx District Attorney’s Office’s request that he be remanded, and also issued an order of protection for the girl. Rivera’s attorney Anna Sim had asked the judge for a partially secured bond of $30,000 at 10%.

Rivera appeared in court dressed in a tank top and khakis, fidgeting and trying to hide behind his attorney to avoid being photographed by news cameras. He held his head down during the proceeding.

Stepdad Abraham Perez previously told The Post he was walking the girl to buy snacks on Fox Street and St. John Avenue when Rivera made a beeline for them at around 3:15 p.m.

Rivera allegedly yanked the girl by her collar and pried her away from her father, pulling the child down the street, prosecutors said

“The girl screamed and fought and thankfully, ultimately broke away and ran back into her father’s arms while the defendant made his way away from the scene,” Assistant District Attorney Allison Pridmore said in court.

He didn’t get more than a block away before he was arrested by an officer who was flagged down by the shocked stepfather.

“I f–ked up,” the suspect allegedly told police after he was taken into custody, prosecutors said.

Rivera was slapped with charges of kidnapping, unlawful imprisonment, harassment, and acting in the injuring of a child. He will undergo medical and psyche evaluation.

The little girl was left shaken by nearly being snatched from her stepdad in broad daylight.

“This kidnapping caused great harm to the little girl, who is upset, traumatized, and fearful after the attack,” Pridmore said.

Perez said on Thursday his “heart hurts” for his stepdaughter.

“This morning I cried because she came and hugged me and told me she was still worried,” Perez said. The girl was crying at night and “didn’t want to sleep alone,” he added.

“She is a very sweet, lovely girl,” he said. “She didn’t even want to go to the police station to do a report because she was afraid. She is worried for me. She has a lot of questions.”

Rivera had been sentenced to 25 years-to-life in for the 2003 murder of a 33-year-old man but was released in Aug. 25, records showed. He had several other raps including weapons and drug charges dating back to 1998, according to cops.

His next court date is scheduled for Nov. 15.

Sicko ‘predator’ arrested for raping, kidnapping teens, 21-year-old in NYC: cops

A “predator” who sought out troubled young victims has been arrested and charged with the kidnappings and rapes of two teenage girls and a 21-year-old woman in New York, police officials said Thursday.
Andres Portilla, 28, is accused of preying on two 15-year-old girls, one who was reported missing from Wyandanch, Long Island, in August and the other who disappeared from Rego Park, Queens, in December, according to cops.
The third known victim, the 21-year-old woman, also from Queens, was reported missing by her parents Jan. 2 after she went out on New Year’s Eve and never came home, cops said.
“He’s a predator, this guy,” Chief of Detectives James Essig said during an update on NYPD cases at One Police Plaza Thursday. “It looks like he’s praying on girls who are runaways and have some issues.”
Police said the accused rapist’s sick scheme unraveled after he saw a missing persons poster the NYPD put out following the 21-year-old’s disappearance.

Portilla had allegedly coaxed her into his car as she searched for a place to charge her phone outside a Queens 7-11, cops said.
“He tells her, ‘Come into the car and I’ll help you charge your phone,’” Essig said.
“The 15-year-old girl from Wyandanch was in the backseat” at the time, according to the chief.
The Queens teen had been in the car at an earlier date but had been let go by the time of the third kidnapping, Essig said.
After spotting the missing persons poster, Portilla allegedly “panics and drops her off nearby,” Essig said of the 21-year-old woman, who then went to a hospital and reported the crime.
Her parents were worried when she didn't come home after going out for New Year's.The third known victim, the 21-year-old woman was reported missing by her parents Jan. 2.DCPI
The NYPD then launched “extensive search” for the alleged serial rapist, and found him walking down a street with the 15-year-old Suffolk County girl on Jan. 6, Essig said.
The teen also eventually told her story to cops, saying she had met the creep via Snapchat, police said.
“Then we do some data mining and we find another incident with another girl, she’s 15,” Essig said. That girl went missing in December from Rego Park.”
The victims told police that Portilla sometimes allegedly used a wrench or other tool to attack them, cops said. He may have also drugged them.

Investigators are now looking for other possible victims who may have fallen prey to the sicko, police said.
Portilla faces a slew of charges, including three counts of rape, kidnapping, sex abuse and assault and is currently locked up on Rikers Island.
He has prior arrests for criminal possession of a controlled substance, a hallucinogen, on April 19. He also has priors for assault and criminal contempt.

Westchester legislative aide fired after vigilante video accuses him of soliciting 14-year-old

Westchester County lawmakers are facing questions about keeping an aide on the payroll for months — despite being tipped off to a video that allegedly showed him trying to meet with who he thought was a preteen girl.
Legislative staffer Anand Singh, 33, was fired on April 13, months after at least three lawmakers — including the board chairwoman — on the Democratic-heavy Board of Legislators were made aware of the caught-on-tape allegations stemming from a December incident.
The video purports to show Singh allegedly traveling to New Jersey to meet with what he believed was a 14-year-old girl after the two exchanged sexually explicit text messages. The 31-minute video was publicly released last week by OBL Global, a vigilante group that works to expose child predators.
The Westchester District Attorney’s office is now probing lawmakers’ actions leading up to Singh’s firing, and at least two lawmakers have called on Board of Legislators Chairwoman Catherine Borgia to step down because they believe she mishandled the case after becoming aware of the video.
Borgia said this week that when she found out about the alleged footage, she had the county’s Department of Public Safety look into it, but the existence of the video could not be substantiated then.
She said the staffer was quickly fired when the video was released last week.

County prosecutors have requested that lawmakers and their staffers preserve all documents and communications related to Singh and any subsequent actions taken by the board before he was fired as part of their probe, according to a letter obtained by The Post.

“The (Westchester County District Attorney’s Office) has reason to believe that, on or about the time of the Incident, members of the (Board of Legislators) were made aware of the allegations,” part of the letter sent Tuesday states.

The district attorney’s office said it only became aware of the allegations last Friday and quickly launched a probe.

Legislator Colin Smith told The Post this week he got two emails — one in December and one in February — about the sting video tied to Singh before it was released. He said in December he told the board clerk, who contacted Borgia, and he also informed the department of public safety about both emails.

Smith said the December email he received was also sent to Legislator Ben Boykin. Boykin had no comment through the legislative office this week.

The video, which Smith called “reprehensible,” shows a man, who is alleged to be Singh, texting with a decoy who claims she is 14 years old. The texts ramp up to become more sexually explicit after the man originally seems hesitant to interact with the purported minor.

The two also spoke on the phone multiple times about him coming to see her, and at one point confirmed he was bringing “Plan B,” the morning-after pill, and “toys,” the footage shows.

The video concludes when a man who appears to be Singh is confronted by the leader of OBL Global about the alleged illicit messages before he flees from a Newark, New Jersey, building where he and the decoy minor were supposed to meet up.

Near the end of the video, OBL members are seen speaking with police officers.

Singh could not be reached for comment this week. No arrest or charges against him have been reported.

He started at the Board of Legislators in January 2021 and made $76,850 annually before he was fired on April 13.

Newark police said it never received a call to report this December incident as a crime. While the confrontation happened in Newark, the police officers that appeared near the end of the sting video talking to OBL members are from another agency, Newark police said.

OBL Global leader Ramy El-Daly told The Post Friday the officers he’s speaking with are from another episode so viewers could hear him explain how his group conducts each investigation. He said police were not called the night of the incident after Singh left.

The district attorney’s office said it only became aware of the allegations last Friday and quickly launched a probe.OBL GLOBAL, /YouTube
He also said that livestreams are done at the time of the sting operations but are then made private immediately afterward and before they are put back online with better production.

The Journal News, News 12, the Yonkers Ledger and the Yonkers Times have all previously reported on Singh and the video.

Borgia said in a video statement Tuesday that as a mother of two, she took the matter “very seriously” when she was told about it.

“At the time, Public Safety was unable to substantiate the claim that a video existed,” she added. “While the video investigation was occurring, the employee was removed from public-facing duties.”

Borgia posted a letter on the county’s website that she sent the US Attorney’s Office Tuesday requesting a probe into Singh.

“Allegations surrounding Mr. Singh’s soliciting an underage girl became apparent when a video surfaced on YouTube that shows Mr. Singh contacted what he believed was an underage girl,” she wrote in the letter to the US Attorney.

She said in her statement the FBI is investigating. The US Attorney’s Office and the FBI did not return a phone message seeking comment Friday.

But two lawmakers, a Democrat and Republican, have called on Borgia to step down from her leadership position.

“I think she should resign,” Democratic Legislator Damon Maher told The Post Wednesday. “That’s basically all I can say at this point, that I’m convinced the facts that have been delivered to me today and over the last few days, but especially today, I think she mishandled the situation.”

Maher does not believe Borgia should resign completely from the board, but GOP Legislator James Nolan wants her full resignation. He also wants the commissioner of the county’s public safety, Terrance Raynor, to step down because he believes Raynor mishandled the allegations.

Borgia did not return a request seeking comment. She previously said she would assist in any investigation.

A spokesperson for the county executive’s office, which oversees public safety, said calls for resignations in the public safety department are “inappropriate” while the district attorney’s office probes actions taken before Singh was fired.

“The result of the DA’s inquiry will provide a basis for any subsequent action,” spokesperson Catherine Cioffi said, adding any calls for resignations in the department are for “seeking partisan advantage.”

The county executive’s office also sought and received the resignation of Singh from the county’s Asian American Advisory Board.

Yonkers Councilwoman Shanae Williams has also blasted Chris Johnson, the legislator she’s trying to unseat in a primary this year, over board’s handling of Singh.

She questioned when he knew about the allegations, but Johnson said in a statement he didn’t know about the accusations until the day Singh was fired. He also said even as majority leader on the board, he does not have the power to make personnel moves.

NYPD cop had video sex chats with young girls, stored 400 child porn images on laptop: prosecutors

An NYPD cop accused of seeking out kiddy porn on Twitter also engaged in video sex chats with young girls and had over 400 photos of child sexual abuse stored on a laptop found in his home, federal prosecutors alleged at the start of his trial Tuesday.
Timothy Martinez,43, was after “explicit images of underage girls and children” — and compiled a horrifying collection on the computer seized during a 2019 raid, prosecutor William Campos said during his opening statement in Brooklyn federal court.
“Martinez engaged in live video sex chats with underage girls and had them display their bodies — including their breasts and vaginas — and masturbate,” Campos told jurors.
But Peter Brill, defense attorney for the veteran cop and Army reservist, sought to muddy the waters by claiming that the sickening images found on the laptop could have come from any one of the dozens — if not hundreds — of soldiers with whom Martinez shared the computer during stints at military bases in Iraq, Afghanistan and Romania.
“It was a general-use laptop used by anyone Martinez shared a base with,” Brill told the jury.
“These images are disgusting … but this case is about whether Tim knowingly possessed child pornography.”

It was a sharp opening salvo in a long-awaited trial that will determine whether Martinez, a Staten Island resident who was arrested in February 2020, will go to jail for allegedly trying to pay a Twitter user for explicit photos and videos of child pornography via Cash App. Martinez allegedly believed the owner of that account was a minor.

Investigators from the Department of Homeland Security allegedly linked Martinez to the Twitter account that paid the other user, according to an affidavit filed in federal court.

On Tuesday, Martinez wore a Navy blue suit, blue shirt and black tie as he listened to the attorneys trade barbs.

Martinez actively sought out underage girls and had video sex chats with them, federal prosecutors said. Gregory P. Mango
Campos, the federal prosecutor, also said investigators have copies of Skype sex chats that Martinez allegedly had with two unnamed girls.

He met one, a 13-year-old girl, online and allegedly manipulated her into “displaying her naked body for his pleasure,” Campos said.

Brill shot back that the girls Martinez allegedly chatted with never actually saw him — only his picture, which was his Skype account’s avatar.

“The women will say they recognize him but they recognize his picture,” Brill said. “They have absolutely no idea who they talked to.”

Authorities have charged Martinez with possession of child pornography, receipt of child pornography and two counts of exploitation. He faces a minimum 15 years in prison if convicted of all the charges.

He was released on a $150,000 bond on in February 2020, according to SILive.com. He is listed as being on paid extended leave from the department.

The trial is expected to last one week.

Ex-aide to NY legislator charged after being caught on video trying to lure teen girl into sex

An ex-Westchester County legislative aide was charged Monday with allegedly trying to lure a teen girl into sex – two weeks after a sting video documenting the disturbing allegations came to light.
Anand Singh, 33, was arrested Monday for allegedly trying to meet up with someone he thought was a 14-year-old girl across state lines in New Jersey, the US Attorney’s Office for the Southern District of New York announced.
Singh was featured in a video posted on YouTube by a catch-a-predator group on April 13 that allegedly shows him sending lewd texts to the teen decoy before trying to meet the girl inside a Newark apartment building.
Back in December 2022, when the undercover operation took place, Singh repeatedly expressed in graphic and clear terms that he wanted to have sex with the purported minor, prosecutors said.
After Singh was told by the girl she was only 14, he originally said that was “too young,” but then a minute later messaged “I bet you’re f—kin fun to be with,” according to the criminal complaint.
He also suggested to the decoy “[m]aybe we can get a motel or something” among other more sexually explicit messages, the feds said.
Singh also promised to bring Plan B birth control and numerous sex toys before he finally reached the Newark apartment building just after midnight on Dec. 17, 2022, authorities alleged.

“Today’s arrest is a reminder of the inherent danger the internet could potentially pose to our youth and the critical importance to protect them from online predators,” US Attorney Damian Williams said in a statement.

Singh was charged with one count of attempted enticement of a minor. If guilty, he’d face a minimum sentence of 10 years in prison.

Singh was fired from his government job on April 13 when the sting video came out.

Singh’s lawyer Kevin Conway told The Journal News his client “remains innocent at this stage of the proceedings.”

“We look forward to investigating the allegations on his behalf,” Conway said.

The allegations have rocked Westchester’s Board of Legislators over the last couple weeks.

Lawmakers accused now-former board chair Catherine Borgia of not doing enough when she was made aware of a possible damning video allegedly featuring Singh in December.

Borgia previously said she contacted the county’s Department of Public Safety to investigate, and they could not substantiate the existence of a video before it was shared on YouTube in April.

Her Democratic colleagues called on her to resign, which Borgia resisted.

She even sued the rest of the board when they moved to hold a vote to remove her from the leadership post last Wednesday.

She finally stepped down Friday after a judge ruled against her and as her colleagues were preparing to oust her.

She is now just a legislator until her term ends at the end of this year.

Borgia in part blamed “institutional misogyny” for her forced departure even though six of her 16 colleagues are women and the person taking over for her – at least temporarily – is a woman.

“Regardless of party affiliation, County Legislators worked together to protect Board staff, prioritize the Board’s important work, and restore integrity for the people of Westchester,” the board said in a statement after Borgia resigned.
