Fifth Trial Date Set For Priest Accused Of Abusing Man Who Shot Him

BALTIMORE -- The trial of a priest accused of abusing a former parishioner who shot him years after the alleged abuse has been postponed until early next year.

It marked the fifth time the trial for the Rev. Maurice Blackwell has been delayed. This time, the delay was caused by a lack of courtroom space in Baltimore Circuit Court.

A new trial date was scheduled for Jan. 3.

Blackwell was charged with four counts of child sexual abuse of Dontee Stokes beginning in 1989 and ending in 1992.

In May 2002, in the midst of a national scandal involving Catholic priests, Stokes, 28, sh

ot Blackwell three times outside the priest's home.

Stokes was acquitted of attempted murder in December 2002,
but convicted on gun charges. He testified he had an "out-of-body experience" at the time of the shooting. He served a sentence of home detention.

Blackwell was not indicted until 2003.

Pope defrocks priest shot amid abuse charges

BALTIMORE, Maryland (AP) -- A priest who was shot and wounded in 2002 by a former altar boy he allegedly molested more than a decade ago has been defrocked by Pope John Paul II, The Associated Press has learned.

The pope decided in October to dismiss Maurice Blackwell, and the Archdiocese of Baltimore received the official paperwork earlier this month from the Vatican, archdiocese spokesman Sean Caine said Wednesday.

Blackwell, 58, is scheduled to go on trial January 3 on four counts of child sexual abuse against Dontee Stokes. The alleged abu

se began in 1989 and ended in 1992 -- a decade before the Baltimore barber shot Blackwell in front of the
priest's home.

Blackwell has denied sexually abusing Stokes, who was a teenager at the time.

Blackwell's trial has been postponed five times, and the archdiocese received word from Rome just before one of his previous trial dates. Caine said the archdiocese decided then not to make a public statement about Blackwell's defrocking out of consideration for how it could affect potential jurors.

But after receiving requests for information about Blackwell's status from The AP and discussing the matter with the city prosecutor's office, the archdiocese "decided it would be prudent for us to acknowledge that the pope has signed this decree, and it is in effect and Maurice is no longer considered a priest in the eyes of the church," Caine said.

Defrocking, which the church calls laicization, is applied in extreme cases of misconduct. It comes about onl

ter a long process involving the Vatican.

Blackwell, who was a pastor at Baltimore church from 1979 until 1998, was stripped of his churc
h authority after acknowledging having a sexual relationship with a teenage boy in the early 1970s.

But Cardinal William Keeler returned Blackwell to his post after he underwent psychological treatment and no other accusers came forward. However, Keeler barred Blackwell from direct ministry with children.

Keeler removed Blackwell from the pulpit in 1998 following other abuse allegations.

A day before his trial, a defrocked priest broke a long silence on Wednesday to assert his innocence against child sex abuse allegations by a man who shot the cleric three times in 2002 during the widely publicized child abuse scandal in the Roman Catholic Church.

It was the first time Maurice Blackwell, who now walks with a cane as a result of the attack, has spoken publicly about the case. He is charged with four counts of child sexual abuse between 1989 and 1992 -- a decade before Dontee Stokes shot him. Jury selection begins Thursday.

BALTIMORE -- The detective who first investigated sexual abuse claims against a now defrocked priest testified Monday that he had reason to believe the alleged victim had been molested 20 or 30 times and that others also had been

victimized, prompting the defense to ask for a mistrial.


"I found him to be credible," Lt. Frederick Roussey said, describing his interview with the alleged victim, Dontee
Stokes
, after being assigned the case in August 1993.

Roussey took the stand as the trial of the former priest, Maurice Blackwell, entered the second day of testimony. Testimony from Roussey and Detective Shawn Harrison prompted defense attorney Kenneth Ravenell to ask for a mistrial three times, arguing the comments were not fair to his client.

Judge Stuart Berger told the jury to disregard comments about other victims. He allowed the trial to continue, but asked jurors to leave the c
ourtroom
momentarily as he called attorneys up to the bench for a private conference to caution the prosecution and witnesses.

Testimony ended early on Monday because the prosecution's last witness, Monsignor Brian Ferme from the Archdiocese of Baltimore, was unavailable in the afternoon. Prosecutor Jo Anne Stanton said she planned to wrap up her case Tuesday.

pular and highly regarded pastor at St. Edward's Church. He is charged with four counts of sexual child abuse against Stokes, a former altar boy in the church.


Stokes alleges the abuse happened between 1989 and 1992, when he was a teenager. He reported the abuse in 1993, at age 17, but prosecutors declined to press charges. In May 2002, in the midst of the national scandal involving Catholic priests, Stokes confronted Blackwell on a street near where they both lived and shot him three times. After the shooting, prosecutors reviewed Stokes' allegations and charged Blackwell.

ter acquitted of attempted murder, Why? but convicted on gun charges. During Stokes' trial, Roussey testified that he took the allegations seriously and decided to arrest Blackwell on his own, but was told prosecutors weren't going to act on the case.

Under questioning by Ravenell, Harrison said she didn't note inconsistencies in Roussey's 1993 report and the 2002 repo
rt, which had the stronger accusations. In 1993, Stokes never mentioned sodomy allegations he made after the shooting.

Jurors also heard from Stokes' mother, Tamara Stokes Morrison, who testified that her son was a happy child but became withdrawn in his teenage years, worrying her enough to take him to counseling. At one point in her testimony, under cross examination, she angrily glanced at Blackwell, banged on the witness stand and told jurors: "I believe that he abused my son."

"I said, 'You gay or something?' He
said, 'No,
Mom.' I was kind of joking, but he got very offended. He didn't like it at all," Stokes Morrison testified.


Stokes' credibility has emerged as a key point in the trial.

On Friday, Stokes faced intense cross-examination by Ravenell, who tried to portray the Baltimore barber as a deeply disturbed young man who has trouble distinguishing fantasy from reality. Ravenell also suggested that Stokes made up the allegations as a way of dealing with a sexual orient
ation crisis.

Stokes, 29, repeatedly told jurors the abuse really happened, saying: "Mr. Blackwell did what I said he did to me."

He testified that he didn't report the abuse earlier because he didn't want Blackwell to be removed due to his stature in the black Catholic community. Both Stokes and Blackwell are black.

Blackwell, who walks with a cane as a result of the bullet wounds, was stripped of his church authority in 1998 after acknowledging having a sexual relat
ionship with a teen
age boy in the early 1970s. The Vatican defrocked him in October.

If convicted of all charges, Blackwell would face up to 60 years in prison.
