A federal judge has temporarily blocked the prosecution from accessing key information as part of its case against former FBI director James Comey
A federal judge has temporarily blocked the prosecution from accessing key information as part of its case against former FBI director James Comey.
Daniel Richman, a law professor at Columbia who previously worked at the FBI, sued the government last month, claiming it had unlawfully accessed material on his personal computer after charging Comey with lying to Congress.
Prosecutors have been relying on communications between Comey and Richman, who represented the former FBI director, as a key plank of their case.
A federal judge has already dismissed the charges against Comey, ruling that the prosecutor was not properly appointed, but the Justice Department is expected to re-indict him.
Richman claims that material obtained from an earlier investigation into Comey was retained, including material that was not included in the warrant, and then searched again, without a warrant, as part of the prosecution. Richman alleges this has allowed the government to access materials that should be covered under attorney-client privilege.
Federal Judge Colleen Kollar-Kotelly ruled on Saturday that the government’s actions were likely a violation of Richman’s Fourth Amendment protections against unreasonable searches.
The ruling is not the only legal setback the Trump administration has faced this week.
On Thursday, prosecutors was refused a new indictment against New York Attorney General Letitia James, who has been accused of mortgage fraud.
