RAPID CITY -- A Rapid City man has been arrested for second-degree rape after allegedly taking advantage of an acquaintance at his home Wednesday night.
Ryan Joe Duncan, 25, was arrested early Thursday at his home in the first block of Neptune Drive. According to police reports, the 25-year-old male victim had been kicked out of his apartment, and Duncan let him come over to use the telephone to find a place to stay.
While at Duncan's house, the victim reportedly took some medication and had one drink, then passed out. He told police that when he came to, Duncan was sexually assaulting him.
The alleged victim left and called police, who arrested Duncan about 1 a.m. The maximum p
nalty for second-degree rape, upon conviction, is 25 years in prison and a $25,000 fine.
