ASHLAND, Va. -- Police have released photos they hoped would help find the person or persons responsible for a deadly shooting outside the Walmart in Ashland.

Ashley Fricke, 25, of Woodford, Virginia, was found shot and killed inside a car parked at the Ashland Walmart at about 11 p.m. Saturday.


"The person of interest in these photos and video, possibly a female, appears to be wearing a white top, dark pants and boots. The vehicles of interest are a red SUV and a silver/grey/gold compact four-door sedan. The person of interest depicted is believed to be the driver of the sedan involved in the shooting seen leaving in the video," an Ashland Police spokesman said. "Investigators also want to speak to the individuals in the red SUV seen in the video regarding anything they saw during the incident."

Ashland Police were dispatched to the area of 100 Hill Carter Parkway around 11 p.m. Saturday. When officers arrived, they found Fricke fatally wounded inside a car. She suffered a single gunshot wound and died at the scene, police said.

A judge has cleared a woman of a first-degree murder charge and use of firearm to commit murder in the shooting death of another woman in Ashland.

Brittany Wiggins was arrested in February after Ashley Fricke was found shot dead inside a car in the Walmart parking lot in the 100 block of South Hill Carter Parkway around 11 p.m. Feb. 18.

Police said at the time that a verbal fight between Wiggins and Fricke may have led to the shooting.

Attorney Joe Morrissey says Wiggins was confronted by two people upon exiting the store on South Hill Carter Parkway. Morrissey claims Wiggins, who is gay, was trying to get away but was followed by the two people who harassed her about her sexual orientation.

Wiggins, who Morrissey says has a concealed carry permit, then shot her gun in the air. Morrissey says Wiggins then left unaware the bullet struck Fricke.

Morrissey's law firm said in February that it intends to argue Wiggins did not intend to shoot Fricke and should not be charged with murder.

Wiggins also faces charges of use of a firearm in the commission of a felony and shooting into an occupied vehicle.

The Grand Jury will still consider use of a firearm in the direction of people. The hearing will be on June 20 at 9 a.m.

A Hanover County grand jury on June 20 indicted Brittany Lashea Wiggins for murder in connection with the killing of Ashley Fricke, 25, of Caroline County. A November jury trial has been set in the case.

In May, General District Court Judge Hugh S. Campbell dismissed the original murder charge against Wiggins, finding there wasn’t probable cause to support it.

Following that ruling, prosecutors decided to seek a first-degree murder indictment directly from a grand jury, said R.E. “Trip” Chalkley III, the Hanover commonwealth’s attorney.

ASHLAND, Va. – The woman killed in a Walmart parking lot last weekend died from a gunshot wound to the head, the Medical Examiner's Office confirmed Friday.
Ashley Fricke, 25, was found shot dead inside her car in a Ashland Walmart parking lot on Saturday, February 18.
She suffered that single gunshot wound, according to police. She was pronounced dead on the scene.
Brittany Wiggins, 24, of Mechanicsville, was arrested Sunday and charged with First-Degree Murder, Use of a Firearm in the Commission of a Felony and Shooting into an Occupied Vehicle.

Fricke was engaged to be married and worked at Lakeside Primary Care, according to friends.
Investigators said Fricke and Wiggins had no known connection.


Crime Insider sources told Jon Burkett the initial investigation revealed the shooting was the result of a road rage incident.
Wiggins’ defense attorney, Joe Morrissey claims his client fired her gun in the air to scare off two men she said were harassing her for being a lesbian.
"It's very simple," Morrissey said when asked what happened the night of the shooting.
He said Wiggins went shopping Saturday night and was harassed by two men near her car in the Walmart parking lot.
Feeling threatened by the men, Wiggins got into her vehicle and pulled out her gun, Morrissey said.

During the course of the tense exchange, Morrissey said Wiggins fired a warning shot into the air.

"We now know that errant bullet struck the innocent victim," Morrissey said.
"No road rage by my client. She's being bullied by these two people," Morrissey said. "If she feared for her life, and she fired it to defend herself, it's an excusable homicide and there's no crime."
When pressed to provide evidence to substantiate the claims, Morrissey referred to security video released by investigators and posted on WTVR.com.
While the video showed Wiggins' vehicle and another vehicle nearly colliding in the parking, there was no obvious proof to the points Morrissey made.
"The vehicles of interest are a red SUV and a silver/grey/gold compact four-door sedan," an Ashland Police spokesman said the weekend of the shooting.

On Monday, police advised they were no longer looking for the red SUV nor its occupants.

Morrissey said he was repeating information Wiggins told him about the night in question.
Ashland Police referred questions about the case to the Hanover Commonwealth's Attorney. The Commonwealth's Attorney has not yet responded to an interview request.
He said she had no idea anyone was shot and promptly turned herself into police Sunday after images of her in the store were made public.
He said the Wiggins family was heartbroken over the loss of life.
Wiggins is due back in court in April 21. Morrissey said he planned to request a bond hearing before that date

HANOVER COUNTY, Va. (WRIC) — A Mechanicsville woman was sentenced to life in prison on Wednesday for a 2017 fatal shooting outside a local Walmart.

Brittany Wiggins was found guilty of first-degree murder in September for the shooting death of 25-year-old Ashley Fricke.

The shooting happened on a dark, drizzly night in February of last year. According to investigators, Wiggins got into a verbal confrontation with two men in the Ashland Walmart parking lot.

Prosecutors say Wiggins was angry, aimed her gun at the young men and shot and killed Fricke, who was sitting in the car next to them.

First-degree murder is the intentional killing of another person by someone who has acted willfully, deliberately, or with planning. Generally, there are two types of first-degree murder: premeditated intent to kill and felony murder. This definition will focus on first-degree murder involving premeditated intent to kill.

It is important to note that the exact definition of first-degree murder depends on each state’s statute, and its definition will vary by jurisdiction. Most jurisdictions define first-degree murder as cases involving premeditation and deliberation; all other intentional murders are defined as second-degree.

A premeditated intent to kill requires that the defendant had intent to kill and some willful deliberation (the defendant spent some time to reflect, deliberate, reason, or weigh their decision) to kill, rather than killing on a sudden impulse.

Prior planning and deliberation are often closely intertwined. Courts focus on the “pre” in premeditation, and generally look for evidence that the defendant deliberated and subsequently formed the intent to kill prior to the act of killing. This is justified because the defendant must have thought about the murder for a period of time and did not change their mind.

There are several factors indicating premeditation and deliberation. These include: lack of provocation from the victim, actions and words of the defendant before and after the killing, any threats from the defendant before and/or during the killing, whether the victim and the defendant had a poor history, whether there was an additional lethal attack after the victim was already helpless, evidence of brutality, and the nature and number of wounds. However, many jurisdictions concede that there is no bright, arbitrary line when premeditation begins and ends.
