DUNN St residents are gutted and angry after an appeal to stop a mosque being built in their street was thrown out of court.

The proposed mosque had been the target of intensive opposition from residents and from an anti-Islamic website that was investigated by Australian Federal Police after it called on supporters nationwide to oppose the mosque.

The website had been linked to a Cairns businessman who dubbed himself "Sheik YerMami" and called on supporters to "do whatever it takes" to oppose Islam and the building of the mosque

Judge Keith Dodds yesterday dismissed the residents' appeal in the Planning and Environment Court against the mosque being built in the quiet North Cairns street. "We've all been let down and are terribly disillusioned," resident Bill Bradley said.

"We are not happy but that's the way it goes."

Mr Bradley was among a group of 12 residents who appealed against the former Cairns City Council's approval to demolish a house and build the purpose-built mosque opposite the Pioneer Cemetery and Kuranda rail line between low-set Queenslander-style houses.

At least one of the residents who appealed against the mosque's approval has already put his property on the market, with others considering a similar move.

Fellow residents Michael and Kathy Gelling said they were "disappointed" with the outcome, arguing the mosque would ruin the quaint streetscape.

Judge Dodds said the house, which was built in the 1950s and would be demolished, was not "an important part of the s
treetscape of Dunn St" and "to demolish it and replace it with a building which complements the character values of the character precinct will not diminish the precinct".

Recommendations for the construction of the prayer hall and kitchen facilities included fake windows and mature landscaping.

"There should be at least three of these hooded windows on each side of the prayer hall," the report said.

Mr Bradley said he feared the conditions would not be met, given conditions set in 2000 when the zoning of the land was changed to a church such as landscaping were never completed.

Far Northern Islamic leader Imam Abdul Aziz said he was pleased the case had finally been settled, after first being submitted to council early last year.

"We are very happy because basically we ended up with what we had before it went to court," Mr Aziz said.

"What every one has to realise is that everything we have planned is in accordance with the town plan."

Things that happen in Muslim countries should have NOTHING to do with a mosque being built in Cairns. There is NO reason the mosque shouldn't be built and all this stuff about parking and HUNDREDS of cars is just nonsense made up by bigoted, narrow minded people who can't accept a religion outside of their own experience. Good on the Planning and Environment court for dumping the case. And for the record. I'm catholic!

re. comments 45 and 47. The IRA was fighting the british army to achieve a united Ireland - to make Ireland whole again. The protestants in the north resisted the nationalist (mainly catholic but not wholely) movement, thus giving the impression that it was a religious conflict - it never was.

To Julie Walker of Narangba who seems to know everything, please do us a favour and go and live in a Muslim country for a while, not a moderate one, and send us a post card to tell us how you managed on your own to visit the sights without being seriously hindered by the local people because of your supposedly female western appearance.How many Muslims do you know, how many have you known, interacted with?, what do you know of Muslim culture to pretend you can give
words of advice, the reality is that you know nothing of it and stick to cooking muffins in your kitchen!I know of their complexity, their friendly and bullish nature, their friendship and hospitality and total intolerance, their belligerence, brutality and their gentle refined ways.People like you contribute to the end of the Western free world as we have known it and bear a strong responsibility in its fall.

They need this 'Mosque,' because they also pushing to have more than one married partner in bed. So Islamic population will be growing and this 'Judge' is 'BODOH' or perhaps having a lot of Islamic friends. We don't want our children near such building. I must say that I have NEVER had a Muslim come knocking on my door decrying other religions and trying to force their religion down my throat like t
he seven day bike riders, the morons, and the witless witness do on regular occasions. I also don't get religious crap pushed into my mailbox by Muslims whereas all of the above money grabbing god bothererss do. So good luck to them. The Mosque may even lift the image of the street a bit.

To cc 14/51 Steve 6/51and piet 37/51.We're Australians who have been living and working in this Muslim country for 19 months. We have some devout Muslim friends and work colleagues and they are definitely not discouraged from socialising with us.We often go out together, sometimes to the movies,to the local Maccas, sometimes out to more plush establishments, to the seashore or a museum. Yes, just like we do back home. There has never been a single instance where either we or our Muslim friends have had any reaction other than being joined by other locals, clearly pleased that we're having a good time, and keen to meet some foreigners. The recently opened Catholic
Church in Doha,,a $20 million dollar construction funded entirely by the Emir and Government of Qatar, is well attended each week and no one has suggested burning it down. In fact it's a source of considerable pride and interest to the locals and the opening and blessing by a Vatican official received wide media coverage.Incidentally, Catholic and other Churches are readily found in Indonesia, Aceh,the Philippines, UAE, Bahrain and Dubai to name just a few countries. I do sympathise with the residents of the Cairns street as the placement of a Mosque, Church, fast food outlet or supermarket in a purely residential enclave seems a retrograde step, involving as it does inevitable traffic and noise issues in a residential neighbourhood.However, I see it as faulty and thoughtless planning by the Local Authority,(Cairns City Council) rather than some devious plot to take over the suburb or city..

I don't believe in any religion. As far as I am conce
rned it is a big con and anyone who practices any sort of religion is a d...head. Can anyone tell me, muslims or christians, why they have to have a building to pray in? Why can't they all rock up to the town hall and pray together if they are preaching to the same god? Better still stay at home and pray and leave the rest of the us in peace. I have got news for the lot of them. They can pray all they like, at the end of the day it is not going to make one ounce of difference. If there is a god why the hell is he inflicting all this misery on young children whose only crime was being born. Wake up to yourselves.

Julie Walker of Narangba,,,I Have been to two Muslim countries and in both All religions that were not Islam were bullied and attacked, while the countries Govts may say this and that and have certain laws, it does not and did not stop the violence directed non-Muslims way, from reading all your comments you need to research
past the first page of your Google search, you quote Lebanon quite a bit I see, maybe you should ask the Christians (30% and shrinking fast) there how their relationship with Hezbollah is going, you also mention Turkey, well Julie that country is 99.8% Muslim out of 66 million people that has many violent attacks and murders committed against Christians, Bahrain 100% Muslim, Qatar 95% Muslim, Egypt 94% Muslim, I must point out that in these countries the non-Muslim populations are declining rapidly, so Julie I Fail to see what point you have been trying to make in all your comments when your examples are ALL nearly exclusively Muslim countries with a Government Religious Tolerance Policy that allows no growth of non-Muslim religions and is rarely up held by the authorities to protect non-Muslim people.

In many Muslim countries, Chrisitans do not get permission to build or even repair their churches.Sure,Julie Walker, a lot of Muslim countries have religious
freedom in their laws but out on the streets, its not put into practice.

Lee of Petrie - comment 36 - how many Muslim countries have you personally visited? So you say that in EVERY country mentioned non Muslims are being treated as second class citizens. A little big more research on your part will show just how wrong you are ... go check out the constitution of Turkey which is a secular, democratic republic which has as one of its tenants the "freedom of religion and conscience". Lebanon's constitution also enshrines "freedom of opinion and belief". United Arab Emirates also ensures
that all citizens regardless of race, nationality or religious beliefs are to be treated equally. I am sure I could find more examples by doing further Google searches.
