Trial begins for (Black) man named 'White' accused of killing woman during gas station robbery in Virginia Beach, VA VIRGINIA BEACH, Va. (WAVY) – The jury trial for an accused killer in Virginia Beach began Tuesday as a jury was selected and parties made opening statements. Darius White is charged with aggravated murder for the Dec. 13, 2021 killing of Annie Smith. Prosecutors say that White and his brother, Michael White, robbed Smith’s husband, Steven Smith, as he pumped gas at Harris Teeter. They claim that Darius Smith then grabbed a gun and shot Annie Smith three times as she sat in the passenger seat of the couple’s car. White faces other charges, including robbery resulting in death, robbery using a firearm and three counts of use of a firearm in commission of a felony. He is also charged with possession of a firearm by a convicted felon, but he will be tried on that count at a later date. Prosecutors nolle prosed, or set aside, a first-degree murder charge. Jury selection lasted more than two hours – the parties seating a 12-person jury and two alternate jurors. Smith took the stand, calmly describing a video from Harris Teeter surveillance video of the robbery and his wife’s final moments.

BLACK ON WHITE GRANNY: 'She was gone:' Husband testifies about wife's murder at Virginia Beach gas station by two BLACK brothers VIRGINIA BEACH, Va. — A man accused of killing a 65-year-old woman at a Harris Teeter gas station in Haygood Shopping Center on Dec. 13, 2021 is on trial.​ Annie Smith was shot and killed as her husband, Steven Smith, pumped gas. Monday was the first day of the retrial in Virginia Beach Circuit Court. Darrius White faces an aggravated murder charge as well as charges of possessing a firearm by a felon, four robbery charges and three counts of using a firearm in the commission of a felony. Darrius White had a trial in May, but Judge Jim Lewis declared a mistrial. A spokesperson for the Commonwealth’s Attorney’s Office had said that based upon a reference from a witness, the judge determined that a mistrial was appropriate. White’s brother, Michael White, is also charged with murder. He pleaded guilty in June. The Commonwealth’s Attorney’s Office says he is scheduled to be sentenced on Thursday, Dec. 14.

VIRGINIA BEACH, Va. — A man has been found guilty of aggravated murder in the shooting death of a 65-year-old woman at a Harris Teeter gas station in Haygood Shopping Center on Dec. 13, 2021.
Annie Smith was shot and killed in their car as her husband, Steven Smith, pumped gas.

'She was gone:' Husband testifies about wife's murder at VB gas station​

Detectives say that Darrius White and his brother Micheal White robbed Steven Smith. When Annie Smith saw her husband was being robbed, she pulled out a gun hidden in the car.
In court Tuesday, jurors listened to the police interrogation of Darrius White.
"She had a gun," said White in the video. "My reaction is I'm trying to save my life."

While both the defense and prosecution agreed that White shot Annie Smith, they argued over whether he was guilty of aggravated murder which, according to both sides would mean a sentence of life in prison without parole.
Brandon Emery with the Commonwealth’s Attorney’s office said after the verdict, "Very poetically, this comes on the eve of the two-year anniversary of their loss of Annie," adding, "It's definitely not going to bring Annie back, but the courtroom process and hearing a guilty verdict to hold somebody accountable is going to be one step in the long recovery that they’ll have ahead."
White's defense argued that the aggravated murder meant that the crime was willful, deliberate and pre-meditated.
"Aggravated murder is more for those who plan out crimes," Darrius White's attorney, Kristin Paulding, said after the verdict. "I think the video clearly shows there was some intent to steal or commit a robbery. I don’t think Michael or Darrius went there with any intention to hurt Annie that day."
Micheal White pleaded guilty for his role in Annie Smith's murder and is awaiting sentencing on Thursday.
Darrius White is scheduled to be sentenced on February 15. His lawyer, when asked if they would appeal, said they would wait until after sentencing to figure out the next step.

Steven Smith said in court that he rushed to his wife, “I touched her cheek… there was nothing. She was gone.”

Police say the brothers were driving a car that had recently been reported as stolen.
