I agree Gman cept for the fact that...it appears that ALL but 'one' of these women were unaware of the NIGGER even being made aware of the party. Guilty verdict in rape trial

COURTHOUSE - With a split verdict, a jury convicted a Philadelphia man of raping an intoxicated woman at a Whitpain party last summer but acquitted him of charges he sexually assaulted a second woman at the party.
Aubrey C. Mackie, 22, of the 600 block of Rosalie Street, showed no emotion as the jury convicted him of charges of rape, involuntary deviate sexual intercourse, sexual assault and indecent assault in connection with incidents that occurred with a 20-year-old woman at the July 9, 2005, party at a Rosewood Drive home in Whitpain.
After deliberating more than five hours, the jury acquitted Mackie of identical charges brought on behalf of a 19-year-old woman at the same party.
"It's a mixed verdict. But that jury recognized him as a rapis
t. The jury is holding him accountable for his actions," said Assistant Di
strict Attorney Samantha Cauffman, reacting to the verdict against Mackie.
Judge Richard J. Hodgson increased Mackie's bail to $100,000 cash. Mackie has until noon Friday to post the bail or he must report to the county jail where he'll remain until sentencing time.
Mackie faces a possible maximum sentence of 26 to 52 years in prison on the charges. Hodgson also ordered court officials to complete a background investigation of Mackie. The judge will use that report to assist him in devising Mackie's sentence later this year.
During the three-day trial, the two college-age women testified that after a night of drinking they passed out and that they awoke to find Mackie having sexual contact with them. The women alleged the assaults, which occurred in two separate rooms, took place during a two-hour time span.
With the rape charges prosecutors alleged that the victims were uncons
cious or that Mackie knew or recklessly disregarded that the victims were unaware the sex was occurring.
Howeve
r, the 6-foot 1-inch tall Mackie, who described himself as a "gentle giant," testified the two women were awake and conscious and did not fight the sexual contact.
Mackie adamantly denied the allegations, claiming the sex with both women was consensual.
Testimony revealed that seven women, all coworkers at a Plymouth restaurant, agreed to meet at the Rosewood Drive home of one of the women for the party. No men were to be permitted to come to the home, according to testimony.
However, when one woman, not one of the victims, asked the others if Mackie could drop by the home, no one protested, testimony revealed. Mackie, who also was a co-worker of the women, arrived at the home shortly after 3 a.m. and got into a hot tub with the bikini-clad women and drank alcohol before the sexual incidents occurred, testimony revealed.
Cauffman argued
Mackie took advantage of the situation and the intoxicated women.
Cauffman argued the 20-year-old woman's testimony was corroborated by an emergency room phy
sician who testified the woman showed signs of vaginal abrasions when she was examined the next day. Such abrasions are consistent with sexual assault, the doctor said.
Defense lawyer David Belmont implied the women alleged sexual assault after feeling "remorse" about their conduct at the party.
