NSW: Gang leader shot dead in third suspected 5T execution

EDS: CHANGES KEYWORD FROM DRIVEBY

By Lorna Knowles

SYDNEY, Feb 6 AAP - A founding member of the notorious 5T crime gang was shot dead as he
walked through the door of a western Sydney hotel last night.

The murder of Ro Van Le (Ro Van Le) outside the Cumberland Hotel in Bankstown was the third
suspected execution of a 5T gang member in four years.

Le, 29, was approached by a man of Asian appearance at the front door of the hotel and was
shot several times in the head and chest about 8.45pm, police s
aid today.

The Cambodian/Vietnamese father of one from Bankstown was rushed to Liverpool Hospital but
was dead on arrival, Bankstown Commander Superintendent David Madden told reporters.

Detective Inspector Stuart Wilkins of Crime Agencies said police were looking into possible
links to the murder of former 5T gang lord Tri Minh Tran and his lieutenant Thanh Hoa Nguyen
four years ago.

Tran, 20, and Nguyen, 19, were shot dead as they walked through the door of a McBurney Road
home unit in Cabramatta at 1am on August 7, 1995.

"That's certainly something we'll look into during our inquiries," Insp Wilkins said.

Supt Madden said Le had been drinking alone at the hotel for about an hour.

"He was walking from the premises when (he was approached), some form of confrontation has
taken place and during that episode a firearm has been produced," Supt Madden said.

The killer was described as 160cm tall, of slim build and wearing a coffee coloured sh
irt.

Supt Madden said it was too early to tell what type of firearm was used.

He said police had received conflicting evidence from witnesses about the direction the
offender fled and what type of car he was driving, although a blue Commodore had been
mentioned.

"There are conflicting stories as to what happened out the front of the hotel, there was
mention of a blue Commodore in early reports," Supt Madden said.

"We're comparing statements and trying to get more people to come forward who may have seen
anything".

Insp Wilkins said Le was one of the founding members of the 5T gang about nine years ago.

He confirmed Le had served a jail term but declined to say what for and when he was
released.

"We're putting together a profile of exactly what his activities might have been," he said.

"Being a founding member he was involved in its early establishment and ran with the gang
for a few years.

"Whether he was currently a memb
er or had left as a member is too early to determine and is
part of our investigation".

If was uncertain whether it was an organised hit or a spur of the moment confrontation
which led to shooting, he said.

Anyone with information about the killing is asked to contact Bankstown detectives on 9707
5299 or Crime Stoppers on 1800 333 000.

NSW: Boy begged father not to kill mother

By Gavin Lower

SYDNEY, Sept 8 AAP - A boy who was tied up and had a shirt put over his head begged his
father not to kill his mother after the man had stabbed the boy's grandmother to death, a
court heard today.

The 10-year-old had been tied up and placed in a shower, with his mother bound to the
toilet next to him, after his father crashed through a bedroom window shouting he would kill
everyone, the New South Wales Supreme Court was told today.

Son Thai Tran, 36, has pleaded not guilty to murdering his mother-in-law, Sanh Thi Nguyen,
and maliciously wounding his estranged wife, Minh Trang Pham, at her Yagoona home in south
western Sydney early on April 21 last year.

Ms Pham, 30, told the court through an interprete
r that Tran had jumped through the window
into the bedroom she was sharing with her son and mother about 5am and tore a phone her mother
tried to use from its socket.

She said Tran then chased her 60-year-old mother down a hallway, stabbing her in the back
with a scissor blade saying: "She's making trouble, she's stopping me or everybody from doing
anything. I'll kill everybody."

Mrs Nguyen ran back to the bedroom where she fell down and Ms Pham tried to protect her by
covering her body with her own and was stabbed in the right shoulder.

Ms Pham said that after killing her mother, Tran tied up her and their son "Johnny" and
started talking about killing himself and her.

"Johnny was crying a lot ... (and) said 'Daddy don't kill Mum because I can't live without
Mum'," she said.

Ms Pham said she convinced Tran not to kill her by saying they would tell police her mother
had been murdered by robbers and that he should leave after wiping the
house of his
fingerprints.

She said she and their son had been bound for about 10 hours before Tran left taking a gold
necklace from her mother to make it look like the attack had been a robbery.

Johnny managed to free himself and used a piece of broken glass to cut his mother free.

Tran had pleaded guilty to the manslaughter of his mother-in-law but the prosecution
rejected the plea.

He has claimed he was suffering a major depressive episode at the time of the attack
brought on by the break-up of his marriage.

Tran broke down and sobbed several times while listening to his wife give evidence.

Justice Virginia Bell adjourned the court at one stage to allow him time to compose
himself.

Ms Pham said that despite separating shortly after they arrived in Australia from Vietnam
in 1996, she had still loved her husband.

"I still love my husband very much but every time he came to my place my mother and he
would argue," she said.

The trial is continuing.

QLD: Meat cleaver attack followed "slurs", court told

By Suzanne Klotz

BRISBANE, Feb 9 AAP - A Vietnamese boy attacked a teenage student with a meat cleaver
because he believed he'd been making racist slurs, the Brisbane District Court was told
today.

The 14-year-old Vietnamese boy, who cannot be identified, pleaded guilty to one count each
of assault causing bodily harm whilst armed, wounding with intent to do grievous bodily harm
and unlawful wounding.

Police had originally charged him with attempted murder.

The Vietnamese boy was truanting from school and walking in South Brisbane when he saw
Brisbane State High School student Jesse Lea, 16, walking with a friend.

Defence barrister Brian Devereaux said his client had been told Lea had made vulgar remar
ks
about him and racist slurs against his brother who attended Brisbane State High.

But in sentencing the boy to three years' probation and ordering he perform 200 hours
community service, Judge Nicholas Samios said there was absolutely no evidence that this had
been his motivation.

The boy pulled out a meat cleaver and hit Lea in the back from behind, before striking him
on the arm and then again in the middle of his back.

Another lunge to the head was blocked by Lea with a school bag, before the attacker fled.

The Vietnamese boy had told Lea his name was "Venom", which is a gang name.

GRAPHIC footage of a machete attack on a bouncer outside a city nightclub has been played to a preliminary hearing for five co-accused.
The footage - from several different angles - shows a group of young men sworming on Bubble nightclub bouncer, Ahmad Chokr.
Mr Chokr, 20 at the time of the attack on November 21 last year, was hacked across his arm and leg.
Melbourne Magistrates' Court today heard the trouble began after another bouncer confronted a man over a knife that was dropped in the queue of people waiting to get into the CDB club, on the night of its 10th anniversay.
Mr Chokr told the hearing that he intervened and grabbed the patron in a bear hug, and pushed him to the side and asked him to calm down.
He said that was when men across the road in Frances Street pulled machetes and ran towards his colleagues.
Mr Chokr told the court the attack was "really quick".

In his tendered statement, he said the group "came running back waving machetes" and chased another bouncer before turning on him.

He told police he was then struck three times "very hard" to his left upper arm.

"I think I blacked-out briefly and sort of stumbled back towards the door," Mr Chokr said in his statement.
"I knew some of the guards were trying to force these guys back with the machetes....I then remember thinking that I had lost my arm."
Mr Chokr said his right leg was then hacked at least three times.
"The pain in my arm and leg then was incredible," he told police.

He said he thought he was going to die.

Mr Chokr was taken to Royal Melbourne Hospital where he underwent emergency surgery.
The five accused - Cong Thanh Nguyen, 21; Chris Lay, 22; Trung Tam Khuu, 20; Phu Hieu Nguyen, 20; and, Jason Duong, 20 - are facing charges ranging from intentionally causing serious injury to affray and unlawful assault.
The hearing before Magistrate Fiona Stewart continues tomorrow.
