DA: Death penalty out in all but one of four torture slaying suspects

Death is no longer a possible fate for three of four defendants in the January 20007 torture slayings of a Knox County couple.


Assistant District Attorney General Leland Price has filed notice of an intention to seek the death penalty as punishment in the deaths of Channon Christian, 21, and boyfriend Christopher Newsom, 23, only against alleged ringleader Lemaricus Davidson.

Price this month notified attorneys for Davidson's brother, Letalvis Cobbins, and Cobbins' friend, George Thomas, that he will push for a fate in their cases no more than life without possibility of parole. Because Cobbins' girlfriend, Vanessa Coleman, was acquitted of a direct role in the deaths, Price hasn't filed a notice of punishment sought in her case.

The move comes after a special judge ordered up new trials for all four defendants in the wake of a prescription pill abuse scandal involving the judge who once presided over the case. The pleadings filed by Price seem to settle the question of whether retrials might serve up a second shot at death as punishment for all four defendants.

Jurors chosen from two different counties rejected death as punishment in the cases of Cobbins and Thomas at their trials, presided over by Knox County Criminal Court Judge Richard Baumgartner in 2009. A jury for fourth defendant Coleman also was chosen from outside Knox County and acquitted Coleman of any direct role in the slayings of Christian and Newsom.

Davidson, on the other hand, inexplicably sought a jury from Knox County, where upset over the killings ran high. He was sentenced to death.

Criminal Court Judge Richard Baumgartner, who presided over all four trials, admitted last year that he, too, was a criminal addicted to prescription painkillers. As a result of the myriad crimes a Tennessee Bureau of Investigation Probe showed Baumgartner had committed while on the bench, Special Judge Jon Kerry Blackwood late last year ordered up new trials for Davidson and his alleged crew.

Under Tennessee law, only a jury can impose death or life without parole as punishment. In cases where either penalty is sought, a prosecutor must convince the panel that certain "aggravating factors" listed in state law outweigh any "mitigating factors" also cited in state law before determining death as punishment.

Price's filings solidify what most courtroom watchers had opined — the so-called double jeopardy provisions of the U.S. Constitution that prohibit a retrial of a defendant declared innocent also apply when a jury rejects death as punishment.

The state Attorney General's Office is asking the state Court of Criminal Appeals to put on hold Blackwood's retrial rulings pending appeal. The appellate court has not yet issued an opinion on the issue.

A decision Thursday by the Tennessee Supreme Court puts new trials on hold for three of the four defendants in the Channon Christian and Christopher Newsom murders.

The justices were asked to review the order granting new trials for Lemaricus Davidson, Letalvis Cobbins and George Thomas, all convicted in connection with the kidnapping, rape and murder of the young Knox County couple.

Judge Jon Kerry Blackwood granted the new trials based on former Judge Richard Baumgartner's admitted drug addiction.

Thursday, the Tennessee Supreme Court ruled that a trial judge's misconduct outside the courtroom does not necessarily require a new trial unless the misconduct is shown to have affected the trial proceedings.

"Although given the opportunity, the defendants failed to offer any proof that the original trial judge's misconduct outside the
courtroom affected the integrity of the trials," the order stated.

The Court acknowledged that "the public's confidence in the judiciary is undermined by irresponsible and improper conduct of judges in both their professional and personal pursuits."

The Court described Baumgartner's misconduct outside the courtroom as "a clear and palpable" violation of the Code of Judicial Conduct, and cautioned that its "order should not be construed as condoning or excusing" Judge Baumgartner's misconduct.

The court now sends those three cases back to Judge Blackwood, who can now reconsider those motions for new trials on other grounds, "under the legal standards as clarified in the Court's ruling."

A retrial for the fourth person convicted in the case, Vanessa Coleman, is still on track to be held in November with a sequestered jury from another county.

With the trials of her three co-defendants still on hold as a new judge takes over, Vanessa Coleman will face another jury next week. That jury will come from West Tennessee.

Coleman was the only woman charged in the brutal murders of Channon Christian and Chris Newsom. The young Knox County couple was carjacked, raped, and killed in 2007. Four people were charged in connection with their deaths, and three men were found guilty of first degree murder. Coleman was found guilty of facilitation of Christian's murder.

All of those convictions were thrown out when the presiding judge, Richard Baumgartner, admitted to a prescription drug addiction. After a prolonged court battle, Judge Jon Kerry Blackwood was removed from presiding over the cases of Lemaricus Davidson, Letalvis Cobbins, and George Thomas.

However, Blackwood will still preside over Coleman's case, because her retrial was not challenged by prosecutors. It is set to begin Tuesday.

Wednesday, Coleman's defense attorney Ted Lavit revealed that jury selection will be held Friday in Jackson. According to the Madison County Circuit Clerk, Kathy Blount, there are 500 potential jurors that can be questioned. She expects jury selection to be completed on Friday.

Normally, that information would come from the county court clerk's office, but they directed us to Judge Blackwood. On Tuesday, when we contacted the Administrative Office of the Courts to find out where jury selection would be, we were told that, according to Judge Blackwood's office, "that information was not available."

John Gill, Special Prosecutor for the Knox County District Attorney General's Office told us that it was the understanding of the D.A's office that Judge Blackwood didn't want that information released.

In their fight to get Judge Blackwood removed from the Christian/Newsom cases, prosecutors raised concerns that the judge worked to keep details of the judicial process in this case from the media and the public.

Davidson County Jury Will Hear Knox Murder Case

NASHVILLE, Tenn. (AP) - The Davidson County Criminal Court has summoned 480 people as potential jurors in a Knoxville murder case.

The Knoxville News Sentinel reported this will be the second trial for George Thomas, who was convicted in December 2009 in the torture and slaying of a young Knoxville couple. Thomas, of Lebanon, Ky., was sentenced to life without parole.

He won a retrial after the judge in the case abruptly left the bench in a prescription pills and sex scandal without having affirmed the verdict.

Thomas has maintained he is innocent, saying he was inside the home where 21-year-old Channon Christian and 23-year-old Christopher Newsom were held but took no part in crimes against them.

Once jurors are selected, they will be bussed to Knoxville on Sunday. The trial begins Monday.

Witness: Thomas Sat Silently In Chair

KNOXVILLE, Tenn. (AP) - A woman who was in the house where a young Knoxville couple was taken after being carjacked has testified defendant George Thomas did not take part in the crime.

Daphne Sutton testified Tuesday at the retrial of Thomas in the 2007 killing of Channon Christian and Christopher Newsom.

The Knoxville News Sentinel reported Sutton -- the girlfriend of Lemaricus Davidson, who was earlier convicted in the slayings -- testified Thomas sat in a chair and never spoke when she went to the house the day after the couple was kidnapped.

Defense attorney Tom Dillard told the jury Thomas, of Lebanon, Ky., "kept his head low, smoked his dope and stayed detached" in order to survive. How's dat work'n out fo' ya, my nigga, knowha'm'say'n.

Thomas would face a maximum of life without parole if he is again convicted.

Prosecutor Glad New Jury Reconvicted Knoxville Suspect

KNOXVILLE, Tenn. (AP) - The special prosecutor who pressed the state's case against a pill-addicted Knox County judge said he was relieved that a jury again convicted a suspect in the torture slaying of a young couple.

Retired Sevier County prosecutor Al Schmutzer told the Knoxville News Sentinel the jury did the right thing again in convicting George Thomas earlier this month. The jury did the right thing, you didn't, coward. This nigger could have at least got what he started out with, which wasn't def, but YOU had to lessen the charges! :cursin:

New trials for Thomas and another defendant were required when trial judge Richard Baumgartner was found to be abusing pain pills. The victims in the case were Channon Christian and Christopher Newsom.

Schmutzer said it was imperative to get Baumgartner quickly off the bench, so Schmutzer said he negotiated a guilty plea to a lesser charge. I regret to inform you that this is unacceptable. You will pay for this. :steamin:

Convict's Lawyers Contest Consecutive Sentences

KNOXVILLE, Tenn. (AP) - Lawyers for a felon who was convicted for a second time in the torture slaying of a young Knoxville couple are contesting their client's sentence.

According to the Knoxville News Sentinel, defense attorneys filed court papers this week, contending George Thomas should not have received consecutive terms in the 2007 deaths of 21-year-old Channon Christian and 23-year-old Christopher Newsom. The sentences add up to 105 years in prison -- two murder terms and a rape sentence. What's wrong with that? :confused:

The defense is asking Senior Judge Walter Kurtz to reconsider the sentencing, asserting the jury rejected the grounds for consecutive sentences.

No hearing on the motion has been set.

Lebanon, Ky., residents Thomas, Vanessa Coleman, Lemaricus Davidson and Letalvis Cobbins were convicted in the couple's deaths.

Court Won't Release Files On Knoxville Judge

KNOXVILLE, Tenn. (AP) - A senior judge will not give the families of a murdered Knoxville couple access to investigation files involving a former judge in the case.

Richard Baumgartner left the bench in disgrace after it was revealed he was buying painkillers from a felon in his drug court. His drug addiction led to the retrials of two people in the torture and murder of Channon Christian and Christopher Newsom.

Judge Walter Kurtz on Friday ruled the Christian and Newsome families lack standing to ask for the Tennessee Bureau of Investigation files on Baumgartner to be unsealed. :mad:

In the court order, Kurtz acknowledged that the parents were emotionally involved in the case but said that did not give them the right to access files protected under court orders. :mad:

Two families are fighting to make sure no one has to live through the pain they suffered during trials for their murdered children.

300 times the Christians and the Newsoms walked inside the City County Building and they were there once again on Thursday.

"This is almost like a second home now we've been here so many times," said Mary Newsom.

They came this time with a different purpose.

"I don't want anyone else to go through what we went through," said Mary.

Sitting through re-trails for the murderers that took their daughter and son. All because the judge overseeing the case was a pill addict.

That's why they're meeting with elected officials, drafting a bill intended to wipe the benches clean of illegal drug activity.

"Somebody that is controlling something as important as our justice system- you would think they would have to get a drug screening," said Gary Christian.

A mission that's been in talks for a while now. Although, these families say justice for their kids has finally been served ,closure won't come until the bill becomes law.

KNOXVILLE (WATE) - The Christian and Newsom families are preparing for a new fight. Vanessa Coleman, the woman convicted of facilitating the kidnapping, rape and murder of Channon Christian and Chris Newsom, is up for parole next week.

The families say they will do anything to stop Coleman from getting freedom. They say they are shocked that she's up for parole, and say it makes the holidays even more difficult.

"That's what I'm going to take him for Christmas," Mary Newsom says, describing the present she still gets her son Chris. She puts one near his headstone every year.

January will mark eight years since Christian and Newsom were kidnapped, tortured and murdered.

"We can't fill that chair that's sitting there vacant where Chris would normally sit. We miss him terribly," High Newsom said.

"We had a good time and he was excited that Christmas because Channon was is his life. We were happy for him that things were going the way he wanted them to go. It was a good Christmas. It was the last really good Christmas we had," Mary says, describing the last Christmas with her son.

Gary and Deena Christian say Christmas was their daughter's favorite time of year.

"You could just walk in the room and her smile, she could look at her daddy with that little grin and anything she wanted she got," Deena said.

"She had a short life, but she had a good life," Gary said.

Both families plan to read victim impact statements at Coleman's parole hearing Dec. 10.

"We'll just keep doing it, keep fighting for justice. There's never really going to be any real justice because we can't get Chris back," Mary said.

There is an online petition aimed at keeping Coleman in prison. It has more than 300,000 signatures.

A state appeals court late Tuesday issued an opinion upholding the conviction and death sentence for the ringleader in one of Knoxville's most notorious crimes.

The Tennessee Court of Criminal Appeals in a 91-page opinion rejected every argument advanced by Lemaricus Davidson, who was sentenced to die in the January 2007 torture killings of Channon Christian, 21, and Christopher Newsom, 23.

More than 11 years after the murder of a young Knox County couple, a fifth person has now been charged with killing them.


Davidson's friend, Eric D. Boyd, was convicted in federal court of being an accessory after the fact. He's serving an 18-year prison sentence and is set to be released from federal prison in 2022.

Investigators and family members have always thought Boyd was more involved in the murders, but at the time, Knox County prosecutors said they lacked the evidence to pursue a murder charge against Boyd.

A new indictment appears to indicate that's changed.

On March 20, a Knox County grand jury returned a 36-count indictment charging Boyd with first-degree felony murder, first-degree premeditated murder, especially aggravated robbery, especially aggravated kidnapping, and aggravated rape in the murders.

Vanessa Coleman comes up for parole (again) on December 8. On his Facebook page, Gary Christian wrote:
“Many of you wanted to send your thoughts to the Parole Board and I promised I would put the best way you could contact them and when the right time to contact them. Well now would be the time, her Parole hearing is set for December the 8th. N.S.: Note that two of the gang-rapist murderers are still at large, known only (at last telling) by their DNA profiles.
The Knox News Sentinel’s Jamie Satterfield has long lied about this, asserting that the other two DNA profiles arose simply through the mixing of the semen of half-brothers Lemaricus Davidson (presently on Death Row) and Letalvis Cobbins (presently serving a life sentence), but as a veteran crime and courts reporter, Jamie well knows that it is a biological impossibility for the combination of two sets of DNA to create a third, let alone a fourth DNA profile.
That ought to tell you what kind of a reporter Jamie Satterfield is.


This demon's sentence ends in 2036 when it walks out as an unleashed demon.
